can i use this as false advertising

ok bare with me on this, i'll keep it as short as i can

right, basically, i'm having nothing but trouble trying to replace my phone.
i have finally had a pay out from my insurence company but the only place i can get this exact phone is direct from t-mobile and the only way they say i can do that is by taking out a contract, which would cost about £50 more than what my insurence company have offered me.

thing is, i got about £70 more than the phone is worth if i was to buy it in a differant colour elsewhere. so i assumed t-mobile could work something out.

thing is when i brought the phone it goes through the insurence thing of trying to get you to take it out with them and thats where they say it would cost 199.99 to replace. http://www.t-mobile.co.uk/Dispatcher?menuid=ctl_choose_additional_services&mode=unknown&insuranceTermsCheckbox=serviceTerms%3D%7B1%7D&allowanceSelectionID1=unselected&allowanceSelectionID2=unselected&showIncompatible=&addToBasket.x=58&addToBasket.y=5
surely i could say that they should be able to sell me the handset at the price as they clearly tell you how much its worth.

basically do i have any grounds for an arguement as they are not budgeing. they say i have to take out and buy out another contract if i want that same phone.

any help much appriciated guys
