Barclaycard - Mercers/Claders - DM-Limited - Wescot/Nelson

Hello

I hoping for some advice on this matter, I owe Barclaycard >£4500 worth of debt, my situation is that I was out of work and can not afford to pay them the payment they require so have been paying them what I can each and every month.

Barclaycard passed on the debt to Mercers and in turn Mercers/Calders/ALC then it went back to them

Debt Managers LTD were involved, I CCA'd them and they passed it back to Barclaycard (i did not receive any CCA see below)

bare in mind i am still paying Barclaycard the payments every month and have not heard from them over the last few months

7 days ago I received a letter from Wescot who are dealing on behalf of "Barclaycard" saying contact us and pay us the payment or we will be taking further action, so I thought OK its back to square one and I will write to them requesting a CCA as I did before (which I was planning to do this weekend)

However today I got another letter this time from Nelson Guest & Partners Solicitors who say they are writing on behalf of Wescot who are acting on behalf of Barclaycard, they are asking me to contact Wescot within 10 days or further recovery action will be taken

Am i right in thinking I need to request a CCA to Wescot using the template (i.e. back to square 1) http://forums.moneysavingexpert.com/showpost.html?p=33791621&postcount=11

Just to recap when i CCA'd Debt Managers Limited back then and they requested Barclaycard to send me this and at the same time sent me a letter back saying they passed the debt back to Barclaycard.

However Barclaycard did not actually send me the CCA agreement, they sent a letter saying here it is enclosed but did not enclose anything...

    When you send a CCA request to a DCA, It goes. You >> DCA >> Bank -> DCA >> You

    Since you never put the account into dispute, you just waited for a response. You will need to start with Step 1 and do a CCA request to Wescot.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    thanks, last time DM Limited passed the account back to Barclaycard so I didnt follow it further
    So I will send the CCA request to Wescot and not the Nelson solicitors? or should I send it them both?

    Personally i would send it to Wescot. As the solicitor who is probably just Wescot anyway, has said you need to contact Wescot. This is what you are doing, send the CCA request by recorded mail to ensure it arrives. And do follow it up, with the 14 day reminder and if needed the dispute letter after 14+30 days.

    westcot are bound by Law to request the CCA from Barclaycard. So if they say that you have to write direct, then ignore them. Whilst your request is in place, no-one can take any further action.....make sure that you send by Recorded Delivery!......check delivery status at the Post Office website given on the receipt.
