Change of circumstances 1 year later - advice please

I was discharged from bankruptcy in January 2009 and continued to pay the agreed monthly payments to the debt collecting agency. However in July 2009 I lost my job. I wrote to the debt collectors immediately to inform them of this and was asked to send proof that I was out of work. I sent all the necessary info i.e. P45, Claim for JSA etc together with a letter informing them that I would let them know if my circumstances changed. 1 year later and finally they have changed. I am now in a postion to afford the monthly payments again but, since I wrote to them a year ago I have heard nothing from them. Have they forgotten about me? Has my records been mislaid? Do I really want to be volunteering I can now afford the re-payments again or do I say nothing? Is it unusual that they have not been in contact with me at all within the last 12 months?

Does anyone have any advice/experience of this?

  • i dont know what the official/professional response should be, but if i was in your position i would say nothing for now and save the amount the repayments should be each month.
    this way you get a chance to build up some emergency funds and have the money ready if the collection agency do get in contact.

    Well said!

    I think you would get a better response on the bankruptcy board as there is no way you should be paying any debt that was INCLUDED in your bankruptcy.

    Failing that call national debtline.

    I think the OP was paying an IPA which lasts three years. He really does need to post up on the BR forum.

    I also think he has 28 days in which to inform the OR of any changes in his circumstances.
