Health Laws being flouted perhaps - advice?

Anyone got any knowledge of what the situation is with regard to workers smoking in a 'corner shop' type shop?

The shop is very small and they have open boxes of penny sweets under a glass counter which they use to make up 'mixtures'

Bloke who works there is sitting smoking and the smoke is going over the sweets (amongst other things obviously).

OH pointed out that it maybe wasn't a good idea to be smoking in the shop beside the sweets and the bloke tells him:

"it's ok, they're under glass".

They may be under glass, but it is an open glass cabinet which means the smoke still goes over them.

Needless to say, daughter wont be getting anything from shop now, but I just wonder what the situation is legally.

Surely there must be some sort of health rules that cover this kind of thing?

    I am a smoker but would not buy their sweets either, smoke goes where it wants.


    I also feel that NO SMOKING 'SECTIONS' in bars and restaurants are silly too. Seperate rooms, yes, sections, no.
    Women and cats will do as they please and men and dogs should get used to it.;)

    Might be worth a phone call to your local Enviromental Health office,number will be listed in phone book
    Don`t steal - the Government doesn`t like the competition


  • Your daughter has the right attitude . Once others notice the smoker and realise that the smoke is contaminating other goods the shop owner will get hit where it hurts most , in his pocket , as customers just wont go to his/her place.

    I have never seen a shop owner / worker actually smoking in the shop, the reason for this I assumed was because it would be illegal. Is it illegal?
