Help!!! in need of advice please

I am currently a nurse working for the NHS i am working 18.75 a week, due to the ill health of my my mother i need to reduce my working hours to 9.4hrs a week ..ie 1 day rather than my current 2 days.

My problem being is that whilst my line manager does not have a problem with this, he has told me the final decision comes from Human Resources and he has indicated that this request will more than likely be turned down.

My question is, is there any law that protects me if i am refused, my other option is a career break but obviously i will have no income and unable to work anywhere else. So in essence if i am refused i will be forced to give up work through no fault of my own.

Would this be classed as constructive dismissal?

I have considered all avenues and when the time comes i will be able to increase my hours again back upto 18.75 hrs...any advice or pointers would be greatly appreciated.

    The law surrounding flexible working and dependents only covers those with children under the age of six or disabled children under the age of eighteen. Even then, the employer must consider the request but may refuse it if there are business reasons for doing so.

    Rights relating to time off for other dependants are only for emergencies and unexpected events.

  • I would have thought that the NHS could give you unpaid leave for the one day a week for the period you need. If things get sticky, suggest you go to/join the union and get them to take up your case.

    And while you're waiting for HR to sort themselves out, are there any local nursing agencies who'd be prepared to take you on for 1 day a week? You might find you'd be better off doing that ...

  • I would also ask Human Resources if they have a policy for compassionate leave?
