Access to old calculator?

Hi,

Is it possible to request that payments are changed from old to current system?

My Oh currently pays his mtce thru old system. We have two children one with a disablility, so all these payments are taken into consideration DLA, my Carere's Allowance and Child Tax credits. Under new system it isn't, which I think is so unfair.

    Don't think so, if that were case there would have been many many of us pushing to move over (I'm a PWC & NRPP), I believe and Kelloggs is expert that migration can occur over a set period, but NO you cannot request to just shift the case.

    What you can do though is close the case, for a period of (18 weeks if I remember rightly) then request it is re-opened which will automatically mean it goes onto new system.

    As he's the NRP I don't think he can close case?

    I did read on the CSA website yesterday that they were migrating old to current but there has been a delay due to software & other issues.

    I was trying to work out what he would be paying as he's just got a new job. But the old calculator has disappeared.

    The PWC can close the case and re-open it again in 13 weeks, if you're lucky. You are correct as NRP cannot close the case.

    Q. Can clients ask for their case to be moved to the current child maintenance scheme?

    A. No. It is not possible to ask for a case to be transferred to the current scheme, the only reason people will move to the current scheme is if their case becomes linked to a new child maintenance application made on or after 3 March 2003.
    For example, we will move the first child maintenance case from the old scheme to the current scheme so that both cases are set up on the same scheme if:
    • a parent with care already receives child maintenance for one child
    • they make an application for another child on or after 3 March 2003, and
    • that child has a different non-resident parent to the child the parent with care already receives child maintenance for.

    Another example when we will move a child maintenance case to the current scheme is if:
    • a non-resident parent is paying child maintenance under the old scheme
    • they have a child with another person, and
    • that person makes a claim for child maintenance through us on or after 3 March 2003.

    Sometimes a case can be moved to the current scheme if the parent with care asks us to close their case, and they make a new application for child maintenance at least 13 weeks after they asked us to close their case.

    Sorry I don't think you've got any chance at all -we tried as we would be paying half on CSA 2 than we currently pay on CSA 1 - we went to our MP and tried every which way - but no luck I'm afraid.

    remember if you did manage to get it converted, the payments would be phased in over a period of up to 5 years

    I have always wondered how this thing would fare if it was to be taking to the Court of Session, or whatever high court there is in England since the CSA is a part of the UK Government.

    I reakon they would find that all old rules cases should be moved to new rules.

    Pity we couldnt crowd finance it to raise a challange..lol
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.
