sick

i work in a railway station and in march i slipped at the barrier line i managed to continue work for a week in agony before i went to the doctor who referred me to the hospital. who said i have plantar fascia. i took about 10 days sick only. since then i have had regular physio. i have since come into work and carried on my job even though some days can be agony. this week i am on night shift 10pm till 7am. and my appointment is this morning at 10.30 am. but when i told them last week they said i had to have last night off so i am fit for pyhsio but i have to be in work for tonight. knowing that i had to get myself into day mode for this morning and then when i come into work tonight chances are i would be working on not a lot of sleep. i have since found out the manager on shift didn't write it up in the accident book and he has now left. if i was to go off work 3 times in 6 months i would have been referred to bupa and then i would have not been allowed to work last night or tonight. it seems that the company have buried their head in the sand over this. i was thinking myself to go of sick again just so they would refer me to bupa but have been told if i do this they can fire me. can they do this i have been here since january

    to put it a little less bluntly they can dismiss you on capability reasons but there is a procedure they have to go through.

    You would have thought they would be a bit more sympathetic as the injury was done at work but they don't have to.

    The reasons why you are off work is seperate to your capability at work and you could obviously take further action against the company if they were negligant.

    Or to be more precise - there is a procedure that they ought to go through. But since you don't have 12 months employment then you have no protection, so if they don't there is little to be done about it.

    Is there now any evidence (other than your word for it) that this happened at work, or any evidence that the employer may have been to blame for the accident?

    when it comes to accidents in the accident book i thought you had year and a day to enter them in???

    you should push for this to be filled in retrospectively.....

    also would they have kept the CCTv from that long ago??????

    I doubt it 4 months later. But it may be worth talking to your employer and saying that you had this accident at work and have been having problems since, and asking for a referral to OH. They may (or may not) be helpful. You could point out that although the manager didn't record it (and this was equally your responsibility - you should have made sure it was) there was another member of staff there who saw it happen. You don't have much to loose by it.

    Unless your company keeps CCTV for a long long time this is unlikely, 30 days is about the norm for keeping CCTV
