Child Support Voluntary Agreement

My OH did a voluntary agreement with his ex for child support, we based the wording on the Csa rules basically agreeing to pay for him until the age of 16 or until he leaves full time further education, now as we haven't gone through the csa am I right in presuming this would be until he finishes next year of college which I think is July?
Focusing on clearing the credit cards in 2018 :T

    If it wasn't via the courts, then there is no legal time whatsoever!

    However, if it had gone through the CSA, they expect maintenance to be paid until the September following the child leaving school which is also when child benefit stops. Just so you are aware if you stopped paying it in July, the Parent With Care could seek maintenance through the CSA for August if they wanted to (however un/likely that would be).

    When putting together contracts you should be very careful in what you choose to include so as to avoid any problems in the future. Im really surprised you didnt specify more clearly in the contract that you and your ex signed.
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    But if the contract was not set in court, it is worth nothing and cannot be enforced.

    It's worded as follows:-

    the £x is in full monthly payment of child support for child x and x (whilst they meet the qualifying criteria being that until each child as aforenamed reaches the age of 16 or leaves full time further education (full time further education Beeing deemed as study of more than 12 hours per week upto and including A level standard only.

    That the Agreement will continue to proceed under the terms as set out above until the youngest child, x, reaches the age of 16 or until he leaves full time further education (full time further education beeing deemed as study of more than 12 hours per week upto and including A level standard), at which time this Agreement will end.


    So as you can see above there is no mention of paying for any months ie. Upto the following September, he turns 18 next May and most schools/colleges finish by July???

    Btw not sure How many hours he does at college or when they normally break up at year end?

    I think he does 10 hours a week at college at the moment - we were thinking as it's a private agreement to pay this until his 18th birthday which coincidentally is the same month he would leave his 2 year stint at college - any thoughts?

  • If you have a good enough relationship with the pwc to have a private agreement accepted, then why not ask her what her expectations are and try to come to an agreement...best all round, surely?

    No - not a good relationship I'm afraid, so that's probably not an option -my question is that in theory as per wording on post above, that as per the Agreement once the child leaves college and he's turned 18 we won't have to pay her directly?

  • From what your agreement says, he is not doing the minimum 12 hours now. But is it worth the extra 4 months payments to keep the csa off your back? We can't decide that for you, and nor can we decide for you how likely it is that the pwc will go to the csa.

    So that's why I was thinking it would be better discussed, though I do understand the difficult relationship thing.
