If M Hall havent told you who the debt is with, then in any case you should ask for a copy of the credit agreement.
Thanks Lynz,
The original debt, under dispute, is with Black Horse. The last communication that I have received from BH was a letter, from their compliance section, acknowledging receipt of my previous DPA letter and stating that they were investigating my points and would come back to me by the 12th September. I have received no notification from BH that they were assigning this debt to a DCA.
All the letters (there was yet another letter from MH in with this morning's post - in addition to the one mentioned above) from MH do refer to the BH reference no.
This third letter (arriving today at same time as second letter) is headed 'FINAL DEMAND' and states:
"Despite repeated requests for payment your overdue account with our client remains outstanding.
Our clients have informed us that they are unaware of any legitimate reason for non-payment of their account and although they would prefer an amical settlement, they will not hesitate to commence Legal Proceedings
We trust that this acyion will not be necessary and would request that you call our office immediately.
Even at this late stage there are two options to avoid Legal Action:
1.) The possibility of monthly instalments until balance is paid;
2.) The possibility of a reduced settlement payment to clear your account.
If we do not hear from you by noon 29th September 2006, then your account will be Closed and forwarded for Legal Action. At this point, we cannot accept any form of payment.
No more reminders will be sent."
I am pleased that they will not me sending me any further reminders - a fact I will remind them of should the need arise.
Does this mean, then, that the matter will be referred back to BH, in which case should I forget MH and deal only with Black Horse?
Thanks for any advice.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
