Termination of HP Agreement - Black Horse

Hello
I was wondering if somebody could please help! I have received a Notification of HP Agreement with Black Horse, which is fine as I can not afford to keep the car (long story but I foolishly took out a HP Agreement for him and now he has stopped paying). I have the car however, this is not tax or insured (it is currently in my garage).
All the letter states is that I need to return the car to them with tax and insurance docs (which I dont have!) - I have tried to call BH three times today but they just keep cutting me off.
Can anybody please advise what the process is and what I should do next? I am happy for them to come and take the car!

Hi Flower, by "him" I presume you mean your ex? Does he have the tax and ins documents and can you get them from him?0

Thank you for your reply. Yes sorry was meant to but "ex". There is no way I can get any of the insurance/tax docs from him. I do have the paperwork in respect of the agreement but nothing else!
Basically, it is my ex - abusive relationship and I have a restraining order against him so there is no way of contacting him. I have been paying this car for the last 18 months (at a reduced rate) whilst the car has been sat in my garage! Hence no tax or insurance!
I have moved on now, moved in with new partner and doing up the house. I just need to get rid of this car! I cant afford to pay it and dont want to drive it - at the end of the day it was his and I want nothing to do with him or the car. I am happy for BH to take it back but not sure what the situation is if not taxed or insured and what I need to do - I cant get through to anybody at BH!!!
I was hoping to do the half paid, hand it back option as the car was over 5 years and from my calculations more than half has been paid however upon checking my agreement this option has not been signed - arghhh!0 -
You'll have to ask someone more knowledgeable about HP agreements with regards to handing the car back.
I believe over 1.2 needs to be paid and there to be no arrears. I think you need to hand it back rather than them taking it, otherwise you are still liable for the remainder.
If they do plan to take it, get the car valued to ensure they do not under sell it and expect you to pay for them selling it at under value. i.e. £3000 still owed, car worth £1000. They sell it for £500. They will want £2500.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

In that case Flower, stay well away from him! I can only suggest you write to BH, outlining your situation (without going into too much personal detail) explaining that whilst you have the car, you are unable to obtain the tax and ins docs, but have the hp agreement. Then see what they come back with. But it's better to write, that way you have a record of what has been said.0

If the paper work for the car is in your ex's name and you have nothing to do with the car then you are not responsable for it. Contact IN WRITING and send recorded delivery keeping all recipts the HP company and state that you are not the legal keeper of the car and you are more then happy for it to be collected from your property on x date between x and x time when you will make yourself available to allow access to the veichle.
As you no longer have the log book or any of the cars paperwork, then you are unable to ensure that the veichle has tax, MOT and a valid insurnce on the car. Why they would ask for this is beyond me as once the keys are handed over then they don't need insurance and they can collect it via a recovery veichle which means it wont be on the road so no tax is required. I think thay are just being a bit arsy with this.
Regarding payments that you have made, you may have a case through a small claims court or by looking into a CCJ against him. At least this way you will be able to reclaim your money which you have paid out, bank statements at the ready. I would also keep all letters from them and produce these to claim for inconvenience and harrasment from them.
I would seriously reccomend speaking with with National Debt line on 08088084000. They are really good and offer a superb service. They number is a freephone one.
