Overnight Stays

Hi,
quick question..
I have a court order in place to see my son,..
I have him every other weekend on an overnight stay (pic up sat 10:30am hand him back sun eve 5pm)
I also have him for an extra night in half terms and a weeks holiday in sumer holidays.
I make this out to be roughly 35nights (off top of my head).
Will this create any reduced payment to CSA???

You would have to have your son 52 nights of the year to qualify for a reduction.0

My kids stay 74 nights a year (by Court Order) . . so I shouild have a 1/7th reduction.
But my ex-wife is now saying they don't . . and they not only say they have to accept what SHE says, but they also won't accept any evidence from ME to prove the truth !
My eldest daughter is 18 in 2 weeks, and I've offered to send them her sworn Affidavit confirming it . . but they currently refuse to accept ANY evidence from me! (My case is already being dealt with by the CSA Complaints Resolution Team)
I spoke to the ICE today, and they said to try writing and complain to the Chief Executive, which I have done. But apparently if they still refuse any evidence I have to Appeal, which of course means it goes to a Tribunal which means a 12 month wait for a hearing !

had exactly the same myself. :mad:
i had totally concrete proof too, which they chose to completely ignore. letter from ex to my solicitor, court order, transcripts of texts, etc, etc.
i worked out what my maintainance SHOULD have been and paid that amount via a SO. i did chuckle when they phoned and threatened me with the dreaded DEO... they always work on SE.
NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.

If you're Self Employed they obviously can't get a Deduction of Earnings Order speedster, but if you refuse to pay what is ordered, you will build up Arrears.
That means they'll start Enforcement Proceedings - you'll have a Liability Order, CCJ, then they'll get a 3rd Party Debt Order which means they'll freeze all your bank accounts and take money . . they'll send bailiffs round, and put a Charge on your house !
If you still refuse to pay they can seize your passport and driving license !
These draconian powers are all very well if people are GENUINELY refusing to pay . . . but it's ABSURD that they start using them when they won't sort out father's assessments properly - like just believing the mother's lies and refusing to accept proper evidence for overnight stays.0
