got a bit scared

file wizard replying to a thread of someone elses said ccjs are nver fully removed and can be re-instated etc? they r removed from credit firms, but not from people who you owe money too.
but surely they would not keep it on their books, as it cant be written off against tax then?

can someone advise, i had a ccj in 2001, and 2004, was happy that one would dissapear soon, and both before too long.

please help

  • Hi they will fall off your credit file after six years, however they are never statue barred and can be refiled although filewizzard did say he didn't often see that happen - are your ccj's satisfied?
  • no, not satisifed, although first one was in 2001, so end this year i think

    You should read File-Wizard's post again. Whilst the reference to the CCJ will be removed, from your credit file, the CCJ will, nevertheless, remain enforceable and bailiffs could be instructed, at any time, to attempt to recover your assets to the value of the judgement.
    If, on the other hand, you had a debt against which no CCJ had been granted, and provided that the creditor had not made any attempt to collect it, for six years, then that debt would become 'statute barred' and very difficult to collect.
    CCJs do not go away - The best advice is to look at the CCJ and attempt to make some offer of payments. Only when fully paid, can you ask for a 'Certificate of Satisfaction' from the court. The Entry will be marked 'satisfied' on your credit file, but will not be removed until the 6 years is up.
