Simply Be Fraudulent debt. Help Please

Dear folks,

I really hoping that one of you can help me out. Bear with me as I really need some help.

I recently received a letter from Robinson Way forwarded from my old house asking me to call them to validate that a lived at a certain address. I was extremly surprised as I never was resident at this address (it was simply the address of a girl I was seeing some four years ago) ,and I certainly didn't enter into any credit agreements at any time in the relationship. Suspecting this to be some form of "fishing trip" I decided to wait until Robinson Way contacted me with more information.

I was rewarded with such contact about a month later, apparently the account that R.W. was chasing for was Simply Be. I am absolutly certain that no such credit agreement was taken out with simply Be and baring in mind I left my ex's relationship not on the best of terms I suspect she may have forged the credit application. I'm not at all sure of the route to take, I'm newly engadged/setting up home and am absolutly terrified they'll default my name first and make enquiries later. Does anyone know the route such D.C.A's take in such circumstances? Will they put the account on hold until legalities have run their course? Any advice would be great!!

    If fraud has happened you cannot be held liable for it, as you never entered into the contract.

    See what response you get.

    Send them a prove it letter, the template letter can be found on this forum,post back when you get a reply.

    If she's entered a credit agreement in your name and without your knowledge then it's not going to have your signature on it, it's going to have a forgery. So the part about signing digitally (ie in a font from the list in Word, not in pen from your own hand) becomes extra important.
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

    Thank you for all your help.

    Unfortunately the saga never seems to end.

    I connected Robinson Way and they told me if I contacted the police and they generated a crime (incident) number then R.W. would put the matter to rest. After contacting the Police and happily with a incident number in my hand I sent all details to Robinson Way to clear the matter up by recorded delivery.


    All was quiet for about a week then suddenly a new addition to my Equifax credit report-A default by Robinson Way!.
    A default for a debt I knew nothing about!

    This couldn't come at a worse time I'm newly engaged and I've just put £200 holding fee on a rental property; I obviously lose this (and another £200 for credit checks and drawing up contracts) shoud my credit application be rejected.

    ny further help would be greatly appreciated.

    PS any one know a way of changing my profile name?

    You don't lose the holiding deposit if you fail the credit check only if you pull out.

    And one default won't necessarily mean you fail it, especially if you explain to the LA the situation. You can get the default removed once it's all cleared up.

    I would contact them again and ask for the default to be removed and ask for a prove it letter again.

    Robinsion way should not be adding defaults if they can't prove this is your debt. You can sue them for any damage the default has likely incurred aswell so long as you can show the default caused it.

    I would also get in touch with the credit report company who has listed the default, they should be able to add a notice of correction, until the matter is resolved. Either by them removing it or you taking it to the ICO to remove it.
