Hi all,
I'm currently on a DMP with CCCS and was made redundant at the end of may. I contacted CCCS and advised them of this and was told to make token payments of £5 to all my creditors.
I did this and got a couple of snotty letters from BOS (Halifax C/card) and Call Credit (Citi Card). I Wrote back to each of them stating that I had done as requested by CCCS and that I was starting a new job part way through July and that my payments would resume once I got paid at the end of the month, then they would go up again at the end of August when I got my first full months pay.
Call Credit seem to have gone quiet, but BOS have immediately sent a letter stating that they are starting court action if I don't pay the full £9k immediately!
Obviously this has got me a bit scared and I have written back to them (again) explaining my situation. I have also sent a CCA request as this is a very old card and thought I might be able to use this to get them to back down.
Should I have done anything else?

I know what BO & S are like as i had them on my case a few months ago - they are horrible.
I would make a complaint to Halifax as they are 1 of their in-house DCA's.
If its any consolation - they are full of hot air and soon go away when they see they are not able to bully you.0 -
BOS are Halifax. With a bit of luck they will fail the CCA request, they did with us. It was sweet telling them to go jump.Barclaycard 3800

So if BOS issue court papers what do I do then? They have the 12 plus 2 days to respond, can I just return the court papers to them citing the fact that they have not supplied a valid CCA (as yet).

If they dont supply the CCA after 12 + 2 days then you put the account into dispute.
Any attempt at taking you to court will just look silly on their part.
Chances are they wont anyway, knowing them as i do.0 -
Most of the time its a bluff. No-one can be sure. As I see it you are doing all you can even if it did go to court a judge would see that. Problems come in if you have assets they could go after.Barclaycard 3800
