Faulty mobile phone.

Afternoon,

I am currently having problems with my mobile phone. I purchased it in April 2004 on contract with o2 and since then it keep going wrong. First off it broke in september, so i took it back to Fones4u who sent it off to be fixed, it came back then in October the same happened so again i took it back. Then for the third time in december it broke again, (same fault each time) so i have taken it back again to be fixed. I am still waiting to have it back, but i was wandering what happens if it goes wrong again???

I thought i have heard that if an electrical product goes wrong more than 3 times in the first year then you can have it replaced with a brand new one? Is this true, or do i just have to keep sending it off to be fixed?

This is getting a bit annoying now as its a 30mile round trip to take it back and they do not offer a loan phone while they have mine.

Any help would be great.

    You don't have to wait three times ............when you pick up your phone ,state that you are 'retaining your right under The Sale and Supply of Goods to Consumers Regulations 2002 ,to reject the goods should the fault reoccur'

    (take a note of when you do this and to whom,you could even ask them to sign a note to say you've done this but they don't have to sign it)


    Then if it does have a fualt use this letter format

    And ask for a full-refund or replacement ,whichever you require.


    Goods have to be 'fit for purpose ' and your phone is clearly not if it's got a repetitive fault,you have been more than fair with them and do not have to accept this kind of service.

    ok thanks alot thats great, when i pick the phone up this time i will tell them what you said, and if it occurs again i will then take the letter in to get a new phone.

    What can i do if they refuse when i take the letter in, if it does go faulty again??? Do they HAVE to give me a new one??

    Under those rules yes and I don't think you will have a problem but just incase if you would feel more comfortable ,ring your local trading standards office and they will advice you on that just in case,...................you can do this if the phone gets the fault back before you send the letter.

    You've had the phone repaired more than once .......this is not acceptible,you have been more than fair with them .................and the phone (if the fault reoccurs) will not be fit for purpose and that breaks the consumer rules.

    word of advice never go to F4U they will tell you anything to get your business but are of no help when problems arise as I myself found out. There advert tells you that they will stop you from being ashamed of your phone but give you a brick and charge you £50 for the priviledge when they send your phone off for repair. They also ask you to change phone early and say they will refund your last months line rental if you get your new phone through them as I did 18 months ago; but I guess my refund got lost in the post as I am still waiting. This time I got my new phone from the link and yes it went faulty but they swapped it for a new onestaight away with a new reciept so I know who to use in future.

    Ive had the same problem. Had the phone for 4mnths now and been back twice to get fixed and at least 3 times due to not being able to send or recieve picture messaging. When i tried to get my money back the 2nd time it broke (about 4wks ago) i was told that as the phone is older than 28days (warrenty time) that i can only have it repaired. Got in touch with trading standards who told me to say it wasnt fit for purpose when i bought it and send a letter off. I did and the reply was "well you still cant have your money back as the time has ran out" Thinking trading standards would help again i rang them up only to have..well you cant really do anything else except have it repaired again
    Smile and be happy, things can usually get worse!
