FOS Conclusions A Joke / Advice Welcomed

Hi Guys

Remember me telling you about finally getting somewhere with my compalint to The FOS regarding Halifax, well I've had a huge set back today.

You may remember me telling you that I had a call from Halifax who agreed to set up a repayment plan and refund all charges and interest, well that still stands, but I have just received The Adjudicators conclusions regarding this matter and it wasn't what I wanted to hear.

Basically the adjudicator has said that Halifax had every right to contact me by telephone even though I had requested all contact to be in writing, as there was no repayment plan in place and this was done in order to expedite the matter.

He also states that The FOS expects the customer to be fully cooperative with the banks request for wage slips/proof of income as the bank is entitled to request such information.

As I remain the banks customer they have every right to telephone me to discuss the status of my account, even though I am acting via my third party CCCS.

The adjudicator also states that Halifax never received any documents from CCCS, which I find very hard to believe as I asked them on numerous occasions to forward my repayment proposals and they confirmed that this had been done, and all of my other creditors received my SOA without a problem,Halifax did however receive my payments from CCCS without a problem.

The Adjudicator is now of the opinion that Halifax have treated me positively and sympatheticlly by agreeing repayment plans and suspending interest and charges ( this has only just happened after 6 months of trying and getting nowhere until I got The FOS involved)

I don't know what to do next, as I have what I want in the fact that Halifax have accepted my DMP and froze interest for a further 6 months, plus a Default Notice has finally been issued, The adjudicator says it is his understanding that no further interest can now be added to my account. It is the principle now that Halifax can continue to call me constantly even though I have requested that they contact either my third party CCCS or deal in writing only.

Also quite a bit of what the adjudicator says in his conclusion is not true, for example Halifax ceased collection activity in March, when in fact they agreed to this by telehone but continued to call every day.

It seems that others posters are right and The FOS is a total waste of time.
