I got a letter from them regarding Cap1 cc debt, entitled "letter before action".
In the letter, they want the full debt to be paid within 7 days or the will take "immediate action".
They even Breakdown the costs:
Oustanding Balance to pay now
lnterest
Court Fees
Solicitor Gosts
New Balance if proceedings are issued
Anyone had one of these letters? What happened afterwards?

With the court and solicitor fees add to the debt, and them stating they will take action. I can only assume they have presented an application to the court for a CCJ. And that unless it is repaid they will commence legal proceedings. If the wording was only may and no costs had been add i would assume it is a bluff.
If you cannot pay, or they do not accept payment in instalment offers, you will need to defend against this debt in your local court. Stating the most you can afford to pay giving a budget sheet to the court.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

All the letter before action really means is......letter before the next threatogram is sent out.
Ask them to prove that you owe the debt by sending a CCA request - they have 12 + 2 days from the day they receive it (send recorded delivery), after then the account is in dispute.
Report them to the OFT and trading standards if you wish.0 -

It says in the letter:
"should it be necessary to issue proceedings in the County Court (or the Sheriff
Court as may be appropriate)further additional costs will be added to the balance outstanding."
I assume they are bluffing.0 -
If that is the case then maybe so, but why have they added court costs already?

Most of them are bluffing....
It costs them money to take someone to court and it would hardly be worth their while just to get something like £1 per month back, if anything at all.
As with all DCA's threatograms - its just full of if's,should's & may be's, all designed to scare you into paying up.0 -
From what I gather these work in hand with the now infamous Bryan Carter solicitors who seems to take anything and everything through mcol but can be easily seen off due to lack of paperwork etc.
Might be worth having a look over on CAG forums if you havnt already. Will be literally hundreds of threads.0 -

They havent added the court costs on. They gave me a breakdown of the debt if it went to court, and they won, and the debt would be bigger as a result.
I am going to research Bryan Carter solicitors. So you are saying they are likely to take me to court, or not?0 -
Carter is notorious for obtaining CCJ's against people without their knowledge - so be very careful of him.
If he does then you can easily get it set aside & have the old fool reported to all the authorities.0
