My mum has recently died and I have inherited her house jointly with my sister. My sister lives there (never left home) and is refusing to put the house on the market.
I was in receipt of housing benefit and council tax help. When probate was complete and I declared myself as joint owner of the property my benefits were stopped.
It looks like I am going to have take action to force a sale of my family home, but in the meantime I am facing being evicted from my rented home with my two children because I am no longer getting assistance with my rent. The local LHA won't budge on this because my name is on the deeds to the house, I am tearing my hair out to know what to do.
The obvious answer is to move into my mother's house as it is mine as well as my sister's, but I would have to do it by force. I don't want my kids to go through the atmosphere with my sister if I was to do this.

I would get some legal advise quickly - if you are joint owner you have every right to sell the property - or get it valued and then your sister buy you out with half the value.
She cannot deny you access. But I also understand that the option of moving in there would be very difficult.
Speak to the solicitors who dealt with the will/probate or the CAB.
I think whatever happens this will unfortuantly be a difficult situation and am sure there will be tough times ahead - but your mums wishes need to be adhered to and she wanted you both to benefit from the asset of the house.

I think you should speak to shelter, I think the council home would be yours as if it's your main home, but speak to shelter asap.

HB is for Council properties, LHA is private properties.
