Did the creditor know your address at all time? Ie you haven't moved from where the catalogue was taken out? or if you have you kept them informed?
If you didn't receive court papers and they did have you address you could apply to get the CCJ setaside. But they may then just apply for it again, as obviously it is owed.
Did you/your daughter stop paying altogether when she lost her job? Or did you make token payments towards the debt?
I would think you need to get the amount you need to pay varied. First you'll need to draw up a monthly income & expenditure account to show what you can afford to pay- its probably worth posting that on here so we can tell you if the judge will be likely to disallow any of your costs. But equally remember to budget for annual costs that you don't pay every month (budget 1/12 of the annual cost).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Yes - my daughter was a customer, but because the catalogue is in my name, I am liable for it. I have today received and Income and expenditure form from Bryan Carter. I will fill it in and make an offer, is that the right thing to do.
