Yes, if it's a Consumer Credit Act debt, case law now says that the default date (actually the expiry date of the default notice) is the cause of action.
Would this include an overdraft debt? original agreement from 2007?
Also what exactly does the expiry date of default mean?
(Default date is Apr 2013)

For an overdraft the cause of action has always been clear cut. It's the date the overdraft is called in and that's the date normally recorded on credit reference files as the default date0 -

I am unsure of the date it was called in but i know that the last payment was to Lowell in Feb 2013 via a DMP the Default is recorded as early Apr 2013 according to CRA.
Does this mean that Statute Barr only comes in Apr 2019?
