Hi all new guy here,
I received some excellent advice a while ago about those parasites "mac h" and a previous company "red debt".
To cut a long story short, my wife has received another letter off "mac h" with certain other documents to support "their" claim of her debt. Now their is nowhere it says how much she owes apart from their own figure of £1,523.70. There is a photocopy of an application for a Barclaycard in Nov 1992 which is my wife's maiden name and when she was living with her parents but also another photocopied form from July 1995 in my wife's married name and when we lived in Portsmouth, saying the date of this account opening is july 1995!!
Now i have heard about this STATUTE BARRED when trawling through the forums for help, is this the case for my wife's supposed debt?
Any assistance will be greatly appreciated.

    Well it would depend on when she last paid anything towards this debt or acknowledged that she owed the debt in writing.

    She may have upgraded her account in 1995 which could lead to the confusion over the dates.

    Does she remember having this barclaycard? does she recall when she last used it? Does she recall being chased for the debt before or making any payments towards it in the last 6years? (5 if in scotland).

    Presumably you sent the prove it letter previously?

    Thanks for the reply,
    She cant remember ever having a Barclaycard, she has never paid anything towards this debt, and the only thing we have done is write a letter to mac h asking them for proof that she owes this debt.
    In the last letter we asked as i said for any proof, and these photocopied forms are what she's received back.
    She was chased for the debt before by this red debt company and i'm sure there was a company before them but cant remember the name.
    The proof they have provided is only a photocopy of an application form, an attachment form confirming my wife had a Barclays account and her address and a application processing form?

    15 years ago!!!! they dont stand a chance of recovering this debt,its statute barred, ignore them.

  • Same sort of thing here over a 1993 disputed debt. I think they've just bought a job lot of old debts and are ploughing through them. They're probably hoping their customers have aged a bit too and are now more easily frightened of being labelled a debtor. They're just throwing mud at the wall in the forlorn hope that some will stick. I think they've caught a cold with all of this ancient stuff they're pursuing.

    Hi Toonceltic,

    Muck hall as I like to call them are a bunch of chancing Barstewards who hope people pay without questioning them. If this debt is 15 years old it's definately statute barred and you should send the letter fermi has highlighted. In short, tell them to take a rather long walk off a very short pier!
    If you've nothing decent to say, perhaps you shouldn't say anything.
