  • I am sorry but I am confused as to what you are trying to achieve. It would help if you clarified how many A&L accounts you have, how old they are and which ones have been passed to Rockwell.

    Do you have
    1. A current account (overdrawn) rockwell managed
    2. A loan rockwell managed
    3. A credit card we have a arrangement im place with the cc company

    Which accounts are Rockwell dealing with and how long have you been paying them? accounts 1&2 from above
    When were they opened, specifically was it before 2007? yes we took the loan out to pay for wedding and honeymoon

    As you are on benefits, you should only pay Rockwell what you can afford after essentials have been paid.

    What is your aim? Is it
    1. To keep paying the same amount - (so you do an income and expenditure sheet that confirms what you can afford and tell them) no

    2. To identify if the accounts are enforceable by checking the CCA (you get RW to provide a CCA for each account) YES

    If you are looking at enforceability you need to read through the first few posts of enforceability IV and look at the flow charts in enforcebility III. The charts explain the process so you know what letter to send.

  • also too add i opened bank account in 07 and was passed too rockwell in 08/09
  • ok back again been waiting for the documents i requested and ive had no response from a+l stating they have sold the loan too rockwell :mad:
    but i have had a copy of my original agreement (a photo copy) from rockwell and didn't have to pay for it :beer: it states we took ppi which we had to have if we wanted the loan and we took the loan out in 03/07/2006.

    rockwell are still claiming they collecting on there behalf and a+l say they have sold it :(

    surely this is becoming unenforceable ? how can i find out what has really happened too my loan and who really owns it ?

    If u request the CCA in writing by recorded delivery they have to send it to u. Use the template letter. ALWAYS do everything in writing and ALWAYS send recorded.
    Request that A&L confirm in writing that they have sold the debt to Rockwell, they MUST do this if they have sold it on.
    Do u think the CCA u have received is genuine? Is it definitely a CCA, not an application form? Does it have the prescribed terms on it?
  • hi sofababe rockwell sent me a photocopy of the fixed-sum loan agreement after i just said i wanted a copy for my records no its not a application form. the signatures where myself and my partner signed barley readable and we also got sent the t+c's

    i have all ready told a+l that i would like to have a letter confirming they have sold the loan but they have not responded.( is there a letter on site i can use too force them to tell us ?) i used the this phone call is recorded and is legally binding excuse to try get the letter sent :D worked with rockwell but a+l are dragging there heels.

    and the document i got sent is a copy of the original should have i been sent the one i originally signed ? ( the copy with the actual ink from my pen on)

    The copy they sent u is fine so long as it has the prescribed terms on iy i.e. repayment amount and frequency. Are the T&Cs from the time of the loan or current? If u were forced into taking out the ppi u should claim it back, that will go a long way to paying off the debt.
