Help with a court fee question please

Hi all I have my appointment on thursday I am fairly organised however something has just dawned on me. I am applying for a court fee remission due to low income - I have all the paperwork I need, then I read that it takes 5 days to process the paperwork:eek: So does this mean I have to pay the court fee upfront and then claim it back? I will have to borrow the money and then will it be seen as preferential treatment to a creditor when I receive the fee back and give it back to the person I borrowed it from?

Help please I think I am starting to lose the plot now...............

    I thought you had to apply for the reduced fees ina dvance of your court date, although im not 100%, hopefully someone will bea long very shortly who knows for sure!

  • Hi there, we did it on the same day!!! Hubby at the time was automatically entitled as he was on income based jsa at the time, and i was on a low income. Just took all my evidence down.

    Likewise, if you have the proof you just show them. No processing involved....the clerk just checked it and then gave it back.

    Make sure proof of benefit is dated to within 1 month of your BR date or you won't get the remission and will have to pay full wack and ask for the refund later when you get it.

    double check before you go as well...some courts now will send the refund to the OR instead of giving it back to you

  • thanks tiger, I have got proof of child benefit, proof of ctc, proof of income {ill health pension, but I don't get slips, just one per year} so to cover that I have four months bank statements that I printed off today {it said three but I did four to be safe}

    I am waiting for council to send benefit award for Housing Benefit and Council tax {but the form said not to include in gross annual income} but I am taking form anyway. I have no further income?

    Have I covered my bases?

    You need to give them a ring and ask them to send you a letter to confirm you are recieving these benefits.
