    Hello ,

I am at my wits end with DLA I was awarded low DLA after waiting 8 months for appeal. I asked for a reconsideration and sent a large response explaining every issue and pain I have but they will not change. I find the tribunals a terrible experience and have ran out of steam with them how can they play god? What do i do? I have degenerative arthiritis in knees feet and fingers , diabetic gastroparesis , back pain , chronic fatigue , severe depression.

Not too different experience to me... had a nightmare tribunal experience that I still struggle to believe was allowed to occur. I feel paralysed regarding doing anything about it... not least because I'm aware the key will be medical evidence but I'm unable to get anyone in the medical profession to be in aposition to help... because I ain't going to get medical help...lol. What you can do is ask for supersession if you feel your circumstances have deteriorated and therefore needs increased. However you're possibly like me in that they haven't really increased... they just haven't been recognised by DWP regarding DLA in first place. What I plan to do... is one day get drunk in the hope that makes me take the plunge in pulling the plug on my DLA claim and make an instant re-application. I've been filling in the application form for the last few months now...lol. At a rate of 1 page per month it could well be that the psychiatric appointment ordered in winter might actually take place before I fill in the form... although I doubt it.

I don't know whether that will inspire you or just make you feel worse..lol. It's easy to give the options available to you... quite another for you to actually take them.

It has been 9 weeks since the DLA wrote to my GP about filling in the report, yet they are still waiting for a reply.

I left message after message with my GP to please fill out the form and send it back, yet still I wait.
Even the DLA said that it is very unusual for the specialist report to come back before the GP's report. She is my regular doctor and she knows everything about me. How can I get her to finally fill in the form and send it off before she jepordises my claim?
hi after being on dla for 10 years for various complaints including arthritis high bp depression diverticulitus barretts oesophagus hiatus hernia faceal and urine incontinence my rate was cut from middle care and high mobility to low care and zero mobility after routine review i dont think my doctors report was very helpful didnt go into my ailments and stated that i could do all manner of things which i genuinely cant do the week my dla stopped i was recovering from total hysterectomy which was a problematic op lasting 5 hours as opposed to the usual 1 to 2 hours i was refused supersession which meant they wouldnt look again at my claim. Myadvisor is astounded as he knows problems i have i am unable to walk for long distaces without severe discomfort i am on 11 different items of medication still i know of people here who receive highest dla and have no apparent illness just are good liars without my blue badge i am totally dependant on my family to shop etc feel i am being penalised i always worked and paid my stamps and taxes yet those who n:mad:ever gave anything to the system seem to be able to get everything

Sounds like you need to appeal this award... to go from high mobility to none sounds outrageous. Get hold of a copy of the evidence they've used and ask for a statement of reason for the decision. If your doctor did let you down with their form filling failures then perhaps it is something they can redress in appeal. Other medical evidence that supports your claim of course could help too. Put out of your mind other people's awards..Good luck in your own!

My husband has been on DLA for 10 years after having a triple heart bypass. He is on several medications for his heart plus a spray for angina. He gets difficulties walking as he gets short of breath and has to keep stopping to rest.....
We got a letter last March telling us they didn't think he was entitled and we had to fill in a booklet saying what he could and couldn't do......We heard nothing until 2 weeks ago when they told us they were sending a doctor to the house to assess him.
This morning he had a letter telling him he could no longer claim the high or the low rate....he's not entitled to anything
Now we do intend to appeal and have asked for a detailed description in writing as to why they have refused him....we intend to take it to tribunal if our appeal isn't successful......what I would like to know is who can he take with him as a representative and would we have to pay for this

The amount of help that is available to represent you free has dropped significantly over the last little while due to increasing cuts. These still haven't reached their full extent.
Personally, I'm preparing for the tribunal myself.
Researching the law, and the conditions of entitlement for the benefit I'm on. Preparing some notes, if I'm feeling terrible.

I've just been told that the reason he can't have DLA is because he's over 65.....but he wouldn't qualify for AA as he doesn't need assistance to get around.....so I'm assuming if you cant have one and don't qualify for the other there is nothing else you can claim

    Hello,

From my experience even getting AA nowadays is very difficult. The only advice that I can give you is what others have told me. Evidence, evidence, evidence and never just rely on your GP's support - it might not be given!

Research and read the law and regs on AA.

I don't know where to start on this....one thing we do have in our favour is that we are quite friendly with my husbands GP and he has said he will support our claim.....another thing is when the Dr they sent came to examine him my husband was told to sign the form the Doc had been filling in but not given an opportunity to read it...we have asked for a statement of refusal from the DLA and a copy of the Dr's report....2 things they mentioned in the short refusal letter they sent are fabricated....they say my husband can walk 100 yards at a normal rate....he wasn't asked that ...he was asked if he could walk 200 yards unaided....to which he replied no...I would have to stop and catch my breath and take a puff of my angina spray before continuing on at my own speed.....They also stated that he could go up and down the stairs.......not what he was asked...he was asked if we had a downstairs toilet...he replied no....he was then asked well how do you manage with the upstairs one....he replied I don't use it....I go outside and use the drain....I only clime the stairs once a day and that's to go to bed....and then I have to stop half way and rest........so seems like they are making it up to suit them

If we appeal I'm assuming he won't be able to have DLA but will have to go for AA
