Been reading lots of posts on here but wanted to explain my situation and see if anyone could help!

Basically I've got myself into quite a bit of debt - about £2500

£700 of this is for payday loans, £300 with Wonga, £300 with Payday Express and £100 with Payday UK.

I also owe £200 on a store card which is now defaulted and £200 to Halifax which I completely object to - basically I went overdrawn 2 years ago by 87p and they added so many charges my balance ended up being over £200. I tried to dispute this with them and eventually offered £100 as full and final settlement, which they accepted. I even took my card into the branch like they told me to and my account was definitely closed because it wouldnt let me log into online banking. Then 1 year later I get a letter from a DCA saying its been passed to them by Halifax and I owe them £242! This is now showing on my credit file as a default as well but I dont owe them anything!

The final £1400 is an overdraft with Natwest. I have a student account and in September decided to defer a year at uni. I have now decided not to go back - Natwest will realise this in September and stop my interest free overdraft. I have said to them that I'm thinking of not going back and asked what the situation would be - they said my student account would be switched to a current account with no overdraft facility because of my credit rating - so basically they would just take the first £1400 thats paid in to get their money back! At the moment this overdraft isnt costing me anything, its the payday loans that are causing me to panic, but in September the overdraft will become a very big issue!

Back to the payday loans - the £100 to Payday UK I have had since December and I have got into the viscious circle of just paying the interest and deferring the loan. The other two are more recent and were due to be paid back on the 25th June and 16th July. I couldnt afford to pay off Wonga (25th June) so I payed £63 to extend it to 9th July. However, on 2nd July they tried to take it, one week early! And when there wasnt enough money in my account they took partial payments, so they got away with £200 and cleared out my account! This was on the Friday and I phoned them immediately to be told only their head office could do anything about it and they didnt have a direct number. Their advice was to keep calling back and asking if I had got through to head office or the overflow call centre. I phoned 27 times and didnt get through to head office once before their phone lines closed for the evening. I work 40 miles away from home and travel by train and was stranded without a penny, I was actually crying on the phone that I couldnt get home but they really couldnt care less. They admitted it was their mistake and said they'd pay the money back but they couldnt confirm when.

By the time I stopped trying to call them the train station office had shut so I couldnt even get anyone to go to another station and buy a ticket and have it faxed to where I was, which I know they can do but there is a £20 charge. My only option was to phone a friend and get a taxi to her house so she could borrow me the money for the taxi - £50! I had to borrow more money just to get me through the next few days and cover the cost of getting to work on the monday. Wonga paid the money back into my account mid-afternoon on the Monday but I owed half of the money to friends because I'd had to borrow money to get home! I also dread getting my phone bill after making 27 calls to Wonga from a mobile!

So by this point Wonga had completely messed my finances up and expected me to pay them in full 3 days later! When I called them they offered to put my account on hold for 1 week without adding further charges. This meant though that I was due to pay back Wonga and Payday Express on the same day and I didnt have £600!

Panicking, I started applying online for loans left right and centre, and was declined for everything! I then found a website called loancentre.net that guaranteed to get me a loan. They said they would take £28 as a broker fee but only when they had successfully matched me with a lender. I was charged immediately after entering my bank details, and I was charged £61.50 instead of £28! To make matters worse they couldnt get me a loan at all. All I was approved for was a guarantor loan and I dont have a guarantor! I sent them an email the next day saying I couldnt believe they had taken £61.50 when I hadnt agreed to this, I clearly said I wanted them to cancel my membership and refund my money. I got back an automated response something along the lines of "yes you have paid a membership fee but for this you get the benefits of blah blah blah". They completely ignored all the other points I made! I wrote back and even wrote in capitals PLEASE RESPOND TO THE POINTS IN THIS EMAIL RATHER THAN SENDING AN AUTOMATED RESPONSE. I was even more clear that I was outraged they had charged me more than they said, asked how they could do this without my authority, pointed out they didnt succeed in getting me a loan, requested a refund again. And guess what I got back.. The exact same automated response! I cant find a phone number or any other contact details and dont know what to do. Is there even anything I can do?

By this point I was at an all time low and was terrified that my repayments were due in a few days and I didnt have the money. I also have very old fashioned parents and absolutely can not tell them about my debt and as I live with them I was scared about getting phone calls, letters etc.

Then on Tuesday I got a phone call from a company called Fresh Start financial management. They seemed like the answer to my prayers, saying for £25 per week they could pay off my debts, freeze interest and charges and stop all hassle from my creditors! Contrary to what you might think from the debt I've got into, I'm actually not stupid and decided to thoroughly research this first. When I told the advisor I wanted to do this he said I could verbally agree now and I'd then have 7 days to change my mind, no obligation at all, so I said OK. When the welcome pack arrived, I realised the true extent of the fees. As well as the £300 start up fee, they would be taking £35 of my £100 per month payments themselves!

I also found out that the CCCS do the same thing for free. I'd asked the advisor from Fresh Start if I could get a cheaper DMP somewhere else and he said yes but the free companies will not let you pay this little and will take every penny of your spare income. I did the CCCS Debt Remedy online and they came back with a DMP amount of £98 per month, which actually works out on average about £2 per week less than Fresh Start wanted me to pay! So obviously my mind was made up. I called Fresh Start to cancel and the woman I spoke to said nobody could cancel it apart from Steve, my advisor, and he was on the phone. She said he'd call me back but I was in work when he did. He left a 4 minute long voicemail message saying basically that going with the CCCS would be a big mistake because they are actually paid by my creditors so wouldnt have my best interests at heart. This has got me worried now and I wanted to know if this was true?

He also ranted on about how he thought they were helping me out a lot.. He was shocked I wanted to cancel.. We needed to have a little chat.. Ultimately if I didnt trust him he couldnt buy trust! I know if I call back they are not going to even give me chance to speak! So I want to send a letter but I'm worried that as I only have 7 days to cancel and that runs out on Tuesday if I send a letter tomorrow they might not receive it on time.

My final issue is that I still bank with Natwest so if I do go on a DMP and include that I need to switch banks first. This week I've applied for current accounts with Barclays and Santander and been rejected for both. I know most high street banks offer basic accounts but the thing is I really need a debit card. With getting the train to work its essential as there is no cash machine on the way so I pay my train fares on my card. I also dont really like carrying cash around.

Fresh Start actually recommended an account and I know they probably get commission etc but I've looked it up and it seems OK. Its called Secure Trust Bank. Basically, not sure if anyone knows about it, but you have an account that money gets paid into and direct debits go out of and you have a seperate pre-paid debit card. So you arrange for x amount of money to be transferred automatically each week/month, just leaving enough to pay bills. I think this would be really useful for me as it would stop me overspending, and there are no credit checks so I'm guaranteed to be approved for an account. The only snag is it has a monthly fee of £12.50 a month. I usually would never consider an account you have to pay for but in this instance I genuinely think it could be worth it. If I arranged for only what I can realistically afford to spend to be transferred I would have much better control of my finances and could even do something I've never done before.. Save!

But I am a bit dubious as they have no branches.. Its all online.. But it does seem perfectly legit.

I'm just confused really because I dont know what to do next. I also need to mention that I havent dealt with my debts well.. I just didnt make the payday loan payments that were due on friday which I know is stupid but I couldnt even face talking to them until I know what I'm going to do about all this. Also, since the Halifax debt has been passed to a DCA I've ignored all their calls and letters. I know thats the worst thing to do but I've just been hoping it would all go away.

Now I know its not going to and I really want to sort this out. I actually really want to be debt free! I'm just not sure where to go from here.. I could go with CCCS but I'm worried after what Fresh Start said. I know I could do it on my own but I'd find it a lot harder to stick to.. I'm not good with managing my money as you can probably tell and what appeals to me about setting up a DMP with a company like CCCS is that I only have to make one payment each month instead of paying all my creditors seperately.

But how good are they really? Is it likely that my creditors will keep adding interest and charges? And will they keep contacting me or will it all go through CCCS?

Whatever I decide, I cant set up a DMP until I've got a new bank account so I suppose thats the first step I think. There's just so much to do and I dont know where to start! Any advice at all would be greatly appreciated!

    Ignore what Fresh Start said about CCCS, they are lying to you to confuse you long enough that you can't pull out of the contract. You need to send them a letter recorded delivery first thing monday morning saying you want to cancel the DMP with them. If you send the letter special delivery you can guarantee delivery before 1pm the next day, so you will know it's within 7 days. You should say in the letter you expect a reply by letter confirming that the agreement has been cancelled and that you want no further contact from them afterwards.

    You should also call them now and tell them you definitely want to cancel. Don't listen to anything they say, they are complete shill artists no different from people trying to sell you double glazing - they have training in how to confuse you into trusting them. Seriously, you should do this NOW before it makes your situation worse. It's not true that it has to be the same person you cancel with - you can just cancel with anyone. Don't let them bully you don't enter into a conversation with the guy, just be firm and mean and say you want to cancel now.

    You should also ignore the advice he gave you about a bank account - just open a basic account with Co-Op if you want to control your spending. It's free: http://www.co-operativebank.co.uk/servlet/Satellite/1193206368743,CFSweb/Page/Bank-CurrentAccounts

    CCCS will give you a free DMP. You should call National Debtline and the CCCS to get some real free advice where they won't try to sell you their own products.

    Finally, you should cancel your credit card today so that the payday loans companies can't take your money.

    OK, this is what I would suggest your priorities are

    1. You need to send a letter recorded delivery to Fresh Start (their address is on the website). By sending recorded you will guarantee it arrives by Tuesday. I would also send an email which will arrive with them tomorrow advising them that you are cancelling within the 7 day rule and that a letter is in the post to them.
    2. Open an account with co-op (cashminder basic account).
    3. Make sure you have enough money for your train and essentials for the next couple of weeks.
    4. Work out which companies have your existing card details - it may be worth reporting it as lost (not sure if this will help stop the payday loan companies taking money)
    5. Write a holding letter to all of your creditors see: http://www.nationaldebtline.co.uk/england_wales/temp/3850_53441.pdf. Send these recorded.
    6. Sort out a statement of affairs and post up here
    7. With regards to the settled debt, do you have confirmation from Halifax regarding F&F? If not you should ask the DCA to prove you owe the debt? there is a letter to send but you need to do the other stuff first.

    Do you have any family that can help you out in the short term?

    Just wanted to let you know I'm on a DMP with CCCS and I've opened a Cash Card Account with Barclays, it's a basic account with no overdraft facility and I have a Visa Debit card.

    My one piece of advice is to try and move everything into your new account before starting the DMP, my pay is not going into my new account until the end of July and my overdraft with current account is part of my DMP. CCCS have contacted the people I know money to and my bank account has been frozen which has left me a little short till payday so get the new account up and running ASAP!

    And good luck, I definately recommend CCCS, I was in the process of looking at a DMP where I paid so much a month when I found this site and the link to CCCS. They have been very helpful every time I have spoken to them.

    Thank you both so much for your advice! Like I said I really want to sort this but its just been knowing where to start thats been hard.

    Right, I've emailed Fresh Start and will send a letter first thing tomorrow. Luckily they dont have my bank details or anything but I still want to make sure its definitely cancelled!

    I've already cancelled my card, I did that after Wonga took money on the wrong day. So the payday loans cant take any money from my account, I've got a new card now and nobody has the details.

    I understand what you are both saying about the co-op account being free. But I really think the Secure Trust would be good for me. For example, I earn £210 a week after tax, I could transfer £150 onto the card automatically each week and leave the rest in to cover direct debits. Then I cant eat in to money that isnt mine and they also guarantee no bank charges ever. I actually think it would really help me sort my finances out.

    This week is going to be a real struggle financially, I get paid on Friday though and providing the payday loan companies dont figure out some way of getting money without my card details I should be OK then. As I said in my original post, my parents are very old fashioned and I dont want them to know about my debt so borrowing from family is out of the question. Also, I know pride shouldnt be important right now but in the end I really want to be able to say "I got myself into this mess but I got myself out of it as well!". So it means a lot to me not to borrow anymore

    Do you think I should go with CCCS then? I have all the forms to send off but obviously cant do that til I have a new bank account sorted. Will definitely post the holding letters tomorrow

    I dont have any confirmation about the F&F with Halifax - when I made the payment I asked for written confirmation that it was settled but it never came. They will have a note of the payment on their records though and they will also show that they closed the account

    Hello dd and welcome! Don't worry, you can get that debt cleared. It will take a little time but you will learn some handy hints along the way about how to manage your money, something we all need to know these days. Follow the advice you have been given on here. especially with regard to changing your bank account asap. You might also want to do a statement of affairs (a breakdown of your income, outgoings and debts) - look at the sticky at the top of the threads list, the one marked First time posters, SOA calculator. Complete it, post it on here and people can advise you on where you can cut your costs of living or maybe increase your income. Also get into the habit of writing down every single penny you spend in a notebook-looking back, you will be able to see where the money goes and what you actually gained by spending it (very little in most cases!). Good luck and keep in touch.

    Yes indeed, where does the £388 go? If all your living costs (food, laundry, gas, electric) are covered by your rent, you don't own a car, you have allowed so much for clothing and entertainment, plus mobile phone costs and haircuts, then that £388 is disappearing in dribs and drabs through everyday incidental expenditure. This is where a spending diary will come in useful - personal spending is the first thing that can be brought under control, once you know where it is going! Do you really spend £50 a month on clothes? By going 2 months without buying any new gear that's your Payday debt paid off. That is just one example of how things can be brought under control. It may be possible, once you have identified where the money goes, that you might not need a DMP after all.

    Hi DD -

    In your really long post you did not mention your parents at all, never mind though, better to take control yourself!

    Looking at secure trust, it will cost you £12.50 per month plus £25 opening fee. The only advantage seems to be no fees for refused DD, but you have said that you would be using this account for spends so wouldn't have any DD from it.

    Why don't you open 2 co-op cash minder accounts and use in the same way, i.e. transfer your spends budget and only use it and no more.

    A spending diary is a must, even over a couple of weeks you should get a much better idea of where the money goes. Do you have anything that you can sell on ebay to raise funds to pay off your debts?
