i was told i was debt free, help!

About 5 years ago i got my self i gave my finances to my ex partner who screwed me over. i shouldnt have done it, and have ever since splitting with him repaired all the damage that i let my self get into, or so i thought....

two years ago i was contacted by a debt collection agency (their name i cannot remember as i though the matter was closed until today) saying that they were reclaiming a debt that was originally in my name (everything was in my name although it was for both of us, he had bad credit, and yes i should have seen the warning signs) . My ex partner had agreed to take on the debt when we split as it was technically joint and i took on the others, but it looked like he hadnt upheld his end of the bargin. So i sought legal advice and in the end bit the bullet and contacted the agency to offer payment. They did search after search on my name and couldnt find anything, they then searched his name and it came up immediately and then asked me for his contact details which i didnt have as we are not amicable.

Today i received a letter from an agency (i dont know if it the same one) asking for a different amount of money for the same account. Im so confused and scared. How can this have happened after 2 years? can more than one agency come after you for the same debt? they seem to have just changed it back to my name in the mean time, can they do this? i have taken my finances very seriously for a long time and have worked so hard to fix things and it looks like like everything is falling to pieces in front of me......

    If the first agency have no luck the debt is often sold on to a second agency.

    First step is for you to send a prove it letter in the post in response to the letter from the new agency - see this post http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2
    Then wait and see what they come back with.
    If and when they send anything else let us know what and we'll see what we can advise/suggest.

    Best advice is not to ring them, and at no point admit that you owe this money (yet).

    What sort of debt is it? Catalog? Credit card? Electricity arrears?

    How much is it?

    What's the name of the organisation now chasing you?
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

  • firstly thank you both for replying,

    unfortunately i did contact them today to see what was going on, they now know my address, however they do not know my phone number and i made no attempt admit liability or offer payment, i made it clear that they had told me that the debt was not in my name upon previous contact. however they deny knowledge of previous contact which makes me very nervous as i stupidly didnt keep a record, you think i would have learnt by now.

    the name of the company is CapQuest Investments Ltd who are being represented by HL Legal Solicitors in Association with Sampson and Co. The original financiers were clydesdale who then transferred to Barclays i think.

    The original debt was a credit agreement for a settee, and brace yourselves and remeber i was young and incredibly stupid... £5000. they are now saying its for £6133.76 and are taking me to court this month as i have not replied to any of the letters they have sent. I have not received any of these as they sent them to his parents address and have done for years as admitted liability, apparently......
  • ive just re-read the letter and it appears that they have always had the debt as they purchased it direct from the original financiers. something very odd is going on here.... they had my correct address 2 years ago, then said i had nothing to do with it when i contacted them, and now its back to me?!!!!
