Advice needed. Is my CC debt unenforceble?

My CCA is with Capital One and was taken out back in 2006. I have found an old credit report that confirms the exact date. Capital One won't accept a F & F settlement and have allegedly sold debt on to fredrickson. Neither have yet supplied me with the original CCA.
Is this debt enforceable?
I have read the previous thread relating to the (templates) that can be sent ,and have duly stored them ready for action.

    I have seen loads of faulty Cap 1 "CCAs" and one or two legal ones.

    I would do it prompltly, as once they start legal action you need a SAR which costs more and takes longer.

    I know that it is no longer encouraged that people actually apy their bills now though.

    Even if a debt is not enforceable the money is still owed and is not wiped off. They can demand money, and mark your credit file as defaulted and unpaid. The only thing they cannot do is get a CCJ if you correctly defend the case.

    Regardless of woody, we do encourage people to get debt free by paying back debts not running away. If you find the debt to be unenforceable it gives you greater leverage for full and final settlements.
