capquest writing to an adress i lived at over 25yrs ago

hi guys,

just a bit of advice needed.

i have a capital one credit card debt. small debt which i have planned to pay in nov as part of my plan for debt free.

long story short it has been sold/passed to capquest. these ppl have contacted me by phone and letter i have spoken to them and they have my address.

the other day a letter arrived "telogram" to my elderley mothers address addressed to me. i rang them and i was asked do you live at ??? my answer was you know i do, i have for past 13 yrs and the account is in that address. so why have you not written to me there when you know i live there. in end i put phone down .

two days later mum gets another from a solicitor( i know its not a solicitor just capquest in another name!) not saying about debt ect but ring so they can be sure of the right info!!!

now i have not lived at home in over 25yrs are they mad??? they know my address its the same address the cap one account was in. they have not written to me there at all why write to an address of over 25yrs ago?? this is causing mum some distress as she rang them and told them i do not live there they have my address and she is going to see a solicitor. she isnt but she was furious at them writing there. i have the letter can i forward this to OFT as i think it is ludicrous when they have the right address in the first place but choose not to write to me there. is this just another capquest trick>?

i also add the telogram company said they were a tracing company finding people, i replied well you have the address i live at so why not write to me there instead of an address i have not lived at in over 25yrs, also whos to say after all that time that the present occupiers have no clue who i was?

Hi Louiser,

Unfortunately these idiots are a law unto themselves at times and think they can do what they like. I'll put the harassment letter below for you to send them and hopefully contact will therefore be in writing and at the address you list at the top of the letter. Someone with more knowledge than me should be able to advise on the OFT bit. How long have you had the debt?

Dear Sirs,

Account No: XXXXXXXX

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

Use the clauses in here, about disclosure of details due to "deliberately or through lack of care," sending mail to the wrong address.
