Orange mobile phone service

Hi,

For the last 6 - 7 years I have owed orange £1000 seems like they have forgotton about me, it does appear on my credit file..

Apparently a friend told me that I did not have to pay it back because they havent chased me for over five years....and he also said this means I get it wiped of my credit file with experian..

Is this true..

Please advise..

    Have they never asked you for it? Has there been problems setting up the DD or something?

    As regards to six years, is it now six years since the date the the total debt was billed, or was it say they first sent you a bill for the first bit of it six years ago and carried on billing you say until 4 years ago and you didn't pay it? I know It has to be at least six years since billing it (and over 6 years since the end of the relevant contract) before it is no longer a legally enforceable debt, but I don't know what the credit rules are.

    You should have a look at your credit score - you can do this free with some companies - Credit Expert gives you a 30 day free trial - so you can sign up then cancel before your 30days are up!

    no probs setting up DD

    its been 6 years since I last heard from the debt recovery agency involved in trying to reclaim the monies I owed..

    I dont know where I stand with this to be honest...I am not trying to get out of it but as Im 22 I could do with the grand..

    What do you think I should do/

    In England, Wales and N. Ireland, there is a time limit, usually six years, on starting legal action to claim money owed. Once judgment has been obtained, there is usually a six-year time limit
    The time limit runs from either the date when the money was first owed, or from the last time the debt was acknowledged by the debtor, or from the last time a payment was made.
    If a debtor, contacts a creditor and acknowledges the debt within the six years, the six years (five years in Scotland) will run from the date of the letter.

    The six-year time limit starts running again if any kind of enforcement action is started.

    If you are still paying by DD, you still owe the debt. :(
  • I need advice from anyone who has been in the same situation....

    I had an outstanding amount that i owed to T-Mobile.I set up an agreement with their solictors to pay them monthly installments by cheque.
    I sent cheques to cover the entire debt and actually sent them £25.00 more than i should have by mistake.

    Even after January when i had paid them off, i continued to get demanding letters from the solictors.
    I wrote to them with amounts and dates for them to check their accounts but kept getting the same reprint of the original letter.

    I have contacted my bank, and got copies of the cheques and sent them to them.They still send the same old letter and it is stuck on my credit rating.

    What do i do???HELP!!!

    Write to the solicitor, keeping a copy. Inform them of their mistake and your overpayment. Tell them that if they do not set the record straight and refund you the £25 withing 14 days you will take legal action against them.

    mediasprings - what happens if it has been 6 years since I have heard from the debtors and Orange?

    What I am trying to establish is will it be written off? Will my credit file be clean?

    Please advise?

    As in previous post:
    After 6 years without contact the creditor cannot take legal action to recover the debt.

    Details held on file by Credit ref Agencies:
    Most lenders provide credit account information, about customers to whom they have granted credit, to credit reference agencies. This will include details of the customer's current or past credit commitments and her/his payment record. Credit account information shows whether or not payments have been made on time and, if not, how late payments were. It includes details of the account balance and whether or not the account is in default. Information about credit accounts in default is kept by the credit reference agencies for six years. Information about settled credit accounts is kept for six years from the date the credit account ended.

    I will check my credit report to see if it has been removed in that case...

    If it has presumably there is no need for me to pay it? as I have been a lucky right? and when trying to setup DD or anyother things they will not find out about it , is that right?
