Bailiff Charges
frontrow
Long story short; I had a CCJ for around £1500 against me in January and in February a High Court Bailiff (from Andrew Wilson & Co) turned up demanding the money. I paid him £300 and then set about sorting this through the Courts. After several wrong directions (thank you Courts contact centre) I got the case transferred to a local Court. I informed the bailiffs of this and they immediately sent somebody around to demand more money, £200 this time. At the Court hearing a monthly payment was agreed on the claimants debt but I have now had a letter from the bailiffs demanding their costs which are in the region of £750.
Surely this isn't right?

Hi
You need to get a detailed breakdown of what they have charged you for from the baliffs.
Then you need to compare that breakdown to what actually happened.
Eg they can charge set figures for the first visit, the second visit, for a levy, for turning up to remove goods, for hiriing a van or towtruck etc. But the fees can only be charged relevant to what actually occured.
There is a website run by a user on here herbie21 -baliffadviceonline - I think that gives a specific breakdown of what fees are allowed.
£750 I would hazard a guess is not right.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thanks, I have their breakdown of charges, fairly incomprehensible as it is, and will look this up.
The main issue for me is - can the bailiffs come to me for their charges even though the Court has set a repayment plan for the CCJ?
After all I didn't ask the bailiffs to be involved!0 -
Baliffs can only be involved if you don't pay up the CCJ, so I'm guessing you didn't arrange to pay your creditor after the CCJ was granted?
If they have been to your house to collect money then they will be allowed to charge some fees. But highly unlikely to be in the sort of figures you have mentioned.
I'm not certain if the baliffs fees should be included in the court hearing or whether they can charge them to you independantly. Herbie would know, have a look on her site or if you cannot see the answer try sending her a PM asking for help - http://forums.moneysavingexpert.com/member.php?u=204019A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
If you have arranged a payment plan with the court I think you should be asking the court to call the bailiffs off.
Unless the £300 has been taken off the debt, you need to ask how you get this refunded from the bailiffs.
National debtline have some good leaflets on bailiffs and the court process0 -
I did make an offer but it was refused and I heard nothing until the bailiff turned up.
Just tried Herbie but their inbox is full!0 -
I think Herbie might still get a message saying you tried to PM her. Might be worth trying again later in the day if you haven't got it resolved in the hope she might have deleted some.
You could possibly also try RobertoMoir (ex-baliff) or 10past6 (very good with court processes).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Herbie will get a message that you tried to send a pm.If you've have not made a mistake, you've made nothing0
