Help Please

Hello

Need some advice on a situation, sorry if this in the wrong forum it seemed the most relevant forum for my question.

Thanks in advance for any feedback it will be greatly appreciated

My elderly mother signed up for a new kitchen last month on finance from a company called better living, the deal was she didn't pay anythning for the first year if that helps, she has signed for the finance roughly 35 days ago and she's had confirmation of the agreement through the post, She still doesn't have the kitchen yet as the company have not sent out a surveyor to measure it up yet.

Anyway, long story short, she was basically pushed into doing this by the salesman who come to her house, and now she wants to cancel

Can she still cancel? i figured that since she hasn't actually received the kitchen yet or paid any payments she could? but i'm being told now that after five days you can't cancel?

she signed for the finance on her home premises to if that helps

Thanks for any help

What does it say in the contract that she signed?

  • Thank you, i have looked it says under "rights to cancel" that she has five days after receivng the letter she can cancel.

it's been longer than five days, can she not still cancel bearing in mind she does not yet have the kitchen or has paid any money?

    thank you

Do you have the name of the salesman?

Because you are out of the cancellation time, I guess they could ask that she continues with the order. However, if she cancels or you cancel for her, it seems unlikely that that they have incurred any costs.

I would suggest the best thing you could do would be to write a strongly worded letter explaining that your Mum has decided that she does not want to continue with the kitchen order. She feels that she was intimidated signed because of this.

This may be of help, did your mother receive any communication on how to cancel the agreement, if not, then you may have a case, read the above link.

Also, on the agreement she signed, does it state how long before a surveyor would take to come and measure the kitchen?
