Capquest want me to pay them, not Halifax.

Hi all,
First post from a newbie.
I have an outstanding debt owing to Halifax Credit card of over £8500.:(
I've been ill and unable to work. Halifax have been fine and accepted minimal payments, plus they have also frozen their interest charges.
However, my last 3 payments to Halifax went adrift due to an administrative error. Consequently Capquest have jumped in to service the debt.
Halifax have now found the missing payments in a holding file, so my payments are back on track. I've spoken to them by phone and they have given me a new reference number to use in future.
Meanwhile, Capquest have written to me to say that they will also accept the same minimal payment that I have been making to Halifax CC and that this payment must commence on July 23rd - or else!
I don't want to pay Capquest instead of Halifax CC! Plus, Halifax CC have given me no indication that I must now pay Capquest instead of them.
Any ideas anyone?

Hi,
You should contact Halifax to see what is happening with the account and take it from there. Either way, you can't pay both. And as Halifax have frozen the interest it may be better to try to deal with them. However, it does sound like they've sold it on to Capquest. Deal with them only in writing and if they start harassing you via telephone, send the letter below

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

I would send capquest a letter asking for proof they have a right to collect the debt - you would expect to see a notice of assignment from them before starting to pay them (or any other DCA) any money at all.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Sounds like they are just trying it on, I get this all the time from debt collection agencies - when I tell them I am making minimum payments to the orginal company they try to insist I pay to them instead. I have asked them to provide written confirmation from the original company that they don't want me to pay them and they want the money to go to the dca instead. Not had a single one yet

Think the dca only get their commission or something if you pay them direct but if you are making payment on the debt not really much they can do about it.0 -

OK, that sounds good. :T I've just made another payment direct to Halifax, so I'll now write to Capquest informing them of this and requesting a notice of assignment before I switch.
