Sick Leave, then annual leave before Maternity Leave

Hi, im hoping someone can assist me :)

Im currently being signed off sick by my doctor as my pregnancy is high risk, im 18 weeks. I was planning on starting mat leave at the earliest time i could (28 weeks). My dr wants to keep me off work until this time.

On 1st August this year, i get my new annual leave entitlement (6 weeks) and i rang my employer to ask if i could take some of it before i start my mat leave, she said i cant as im not allowed to go from sick leave to annual leave then to mat leave. She didnt say whether this was because of "business needs" or that its a rule.
She said i could carry the 6 weeks over to next year, which means when i return in september 2011 i will have just accrued another 6 weeks.

Does anyone know whether i can take my annual leave before my mat leave?? it has been known before for the employers to tell us things in the hope we wont check. ive contacted my HR dept, and theyre not very helpful.

    To be honest, I think that annual leave is at the discretion of the employer no matter what the situation. Sorry I can't help further.

    Don't know of any legalities that stop this in fact I think it is common for people to use up their accrued leave berfore going on maternity to avoid having loads to take after.

    Why do you want to take the holiday?

    Is this better pay than the sick pay?

    You won't be working anyway if still on sick.

    Accrue the lot and get paid for it after maternity
    Don't forget any outstanding from this year while sick that can be carried over as well.

    I don't think it is the law as I did exactly that - off at 28 weeks sick for 5 weeks, then I took 5 weeks annual leave and started my mat leave at 38 weeks.
