I would decline this offer, as there are too many negatives and too much risk. filling the swimming pool shouldn't be costly but the concrete could. Lenders won't lend for a reason. However, this type is investment is quite common and you would be able to pick something less risky

I doubt it. To intentionally deprive yourself of assets in order to avoid paying for care has to be done in the context of already knowing you need or are likely to need that care. I'm sure this point could be easily checked out - there are enough equity release schemes for any precedent to have been established.
