mnba credit card illness

I am writing this on behalf of my mother.She has an mnba credit card at £2500 debt, due to her giving up work she is struggling to make the minimum repayment.She has had this card for 6+ and i have an additional card 4+(which i only use to buy concert tickets).my mother has manic depression with phycotic episodes, this has been well documented for 15+,she is now on benifits after 5 months of trying to get her to apply(a very long story)my question is how can i support her to getthe debt reduced, because it is a pre existing condition and she volentary gae up her job her payment protection will not coer this. i lie with her and work 12hrpw, i hae authority to deal with the council for our house and een this is a struggle, even thought i have 58 quid to do me to the 29th they are still wanting £40 a week rent which i dont have, they have told me that i still have to pay or it goes to court, well fat chance of getting anything off me cos i dont have anything.(it took the council from the 19th april until 2july to sort out the benifit claim but this is going to change as well). i help my mother out a great deal but i am also struggling financially as well and my hair is falling out as the result of stress any help and advice is gratefully apreciated. my mum is 42 and im 25 thanks

    Hi Kellie,

    Since you are 25 (over 18) and are an adult, you will be expected to hold down a job and thus pay rent/council tax. Rent and Council tax are priority debts and must be paid on time before anything else. Rent is owed by the person(s) named on the tenancy agreement and Council Tax is owed by people living in the house.
    The council will get a liability order for outstanding council tax and issue bailiffs for collection of money owed. You really need to get into the council offices and speak personally to someone about the issue.

    MIND is a charity that helps with mental health problems, i would contact them. They can help support you and your mom in more than just debt issues, but life as well. - http://www.mind.org.uk/

    Although PPI will not pay out, have you checked if the PPI can be reclaimed anyway? If it was missold to begin with you could reclaim money to repay the CC debt - http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

    i know these are priority debts but where is the money going to come from when i dont have any? the council i am sick and tired of dealing with them i hand everything in when they ask me i have been asked many times for the same thing !!! i have my own bills which i have to pay first! my mum has worked all her life paid all her bills i dont mind helping but if i dont get help soon im going to have a breakdown! my mum will not speak to her phcharist i cant even ge her to go to the doctors. it took me 5 months to get her to apply for benifit. i work but i can only do so much i am a homecarer with a very demanding job. the episode my mother is going through she believes that my gran and pop are not her real mum and dad it is my grans sister she died when she was 6 months old. she believes she has other children and granchildren which she does not im her only child and that she is rich and has millliions in a trust fund, yeah right and im santa claUSE.this is very upsetting for me as she would rather "BE" with her other family.my mother can be quite nasty when she wants to due to her illness but i am at the end of my tether, how can you convine someone these things are not true when she believes they are.???????

    just re read ur post if i was nasty i apoldgise i had a stressful morning. my name is not on the tennency agreement but i have been told i have to pay the rent, all last year i was paying the full council tax and my mum the rent she was struggling with this, the council tax has been reduced a bit i was quite willing to keep paying that it was help with the rent i was looking for my mum, i spoke to the arrears mannie and he told me i had to pay the rent as the council tax had already been paid for the month this is when i get my wages, or else they would be passing the matter on to the court. i have been phoning and handing in the information i have been asked to, but still no luck it's ill try to get someone to look at ur claim but nothing has been done! so my question is can they force me to pay the rent if i have no wages left it?
  • Hi and welcome... have you got a social worker for your mum, it sounds like she may need to be admitted for awhile if she is unstable...you need to talk to someone.. if you care for your mum should you not get a carers allowance... my best advice is speak with a social worker come back soon we are here for support ... x

  • i have tried this i had to phone 4 difrent places and got fobbed off at every turn then to be told i could not make a referal and that her doctor would have to do it fat chance since she wont see a doctor. i cannot get carers allowence as i work and she can eat dress talk and that for herself it's just her mental state but thanks

    Have you tried talking to her doctor? Explain the situation - which he should know about anyway - and see if a home visit could be arranged? He might be able to advise on the best course of action.

    Kellie, with the best will in the world Sweetheart you need to separate the bald and boring facts from the stress and anxiety.

    The stress and anxiety is trying to deal with your mothers illness. That's things like her irrational beliefs about her family and so on.

    The bald facts are that the debt is X amount to X creditor and Y amount to Y creditor and so on. That your mothers income is P amount, of which her expenditures is Q and the remainder is R. Your income is A, expenditure B, remainder C and so on. All this leaves a total debt of L, a total suplus income of M and therefore monthly repayments of N and O (even where N and O are pence). All very dull and colourless as you can see.

    It is the colourless bit that we can help you with here.

    Mind or the doctor can help with the stress and anxiety. I say the doctor because he or she can refer your mother to the CMHT- community mental health team, who will assign her a CPN- community psychiatric nurse. That CPN functions much like a social worker and can offer proper practical and emotional support and help. So I recommend you either phone Mind (who are free to use, confidential and generally lovely) or get your Mum a doctors appointment asap (if she wont go, go without her on her behalf- the doctor will still see you if you insist, although they may do a lot more listening than talking). That's your first priority, managing the debt can be done the day after, for now get some practical real-time help from Mind or a CPN.

    As regards the rest of the debt, you may not have it all, we understand that. What we can do is help you put together a plan which would take what money you do have and make a repayment plan which you can afford. We can help you freeze the debt, we can help you recover money. We do the boring bald facts bit, that's what this forum is good at.

    What we can't do is support the emotional aspect, although beleive me I understand it only too well and have every sympathy it's just not what we do here. Dark Convict is just giving you the benefit of his/her expertise in the boring bit, not because he/she is cold but because that's the kind of help we do well here and Dark Convict is pretty good at that bit as it happens.

    We want to help you, but are mindful of our limits, MSE's not a mental health support service. Even though I volonteer as a support worker for a mental health support service and you'll find there are a great number of people personally affected by mental health issues on this board we still can not help you with the stress side of it here. Get Mind or the doctor onto that. When you're less near your own breaking point and we can do the boring numbers on sheets of paper bit, the debt can wait a day or two, that you are clearly stressed to the max and your Mum is clearly not a well bunny can not.

    No debt is too difficult to resolve. For now though- get real-time support with your Mums behaviour from the places that can help and we'll pick up the bits with the maths when you're ready.

    Oh and Kellie- you CAN get carers allowance. You have been wrongly advised. Again a CPN will have lots of experience in how to fill that form in.

  • thanks hannaha i have already been to ma ma's doctor and he was going to write to her phycarist this takes time, im taking my life in my hands if i go behind her back even if i have the best intrests in mind. i have spoken to her about the credit card but she does not take it seriously, she says it's ok i am looking at other threads aBOUT getting the intrest frozen there has not been purchases in a while so it's not like im spending on it. the payments barely cover the intrest i am looking at options so thankyou for ur kind words x

    Kellie, you need to talk to your Mum's doctor, but you also have to look at the prospect of moving out on your own if she won't accept your help - you say that you would be 'taking your life in your hands' going behind her back and sadly dealing with a manic depressive can be very difficult. It may well be that you would be more able to help her (and yourself) if you were living on your own and she had the support of you, her GP, a psych social worker etc....

    We all have difficult times, and i know how caring for mental health can be difficult so no hard feelings in the post you left, stress runs high when looking after people.

    With regards to debts, the worst that can happen is for council tax is a liability order is made, this is like a CCJ but has no affect on credit rating. Basically if not paid bailiffs will be issued to collect the money owed, if they do not gain access to the house to levy items or levy a vehicle, the most they can charge is £42.50. However if they do get in then costs can rise sharply.

    With other debts, including rent, then it would be a CCJ taken out against the named account holder. Failure to attend the CCJ and defend will always award in favour of the creditor. But anyway if a CCJ is granted it will affect the credit file of your mom for 6 years and this subsequent rating may cause her credit card interest rates to rise as she is seen as a higher risk. If a CCJ is awarded in your absence (you didnt defend) you have 30 days to pay before bailiffs are issued, if you defend and a set monthly payment is awarded, only if a payment is missed can bailiffs be used.

    Your situtation is uncommon but not unique. I cannot give you a step by step solution to this, so i would contact the debt charities mentioned and MIND, explain the current circumstances and just listen to what they have to say and suggust. I would then start on working with the council/landlord to explain the situation and show you have taken advice. Finally move on with contacting social services/doctor etc. Whilst their advice is important this can be a slow step and will not gain quick benifits. Get information, Talk to those who you owe money to, get medical advice.
