NRP then PWC now NRP

I used to be the NRP, the CSA took 40% of my income through a DEO and I almost lost my house, I now have a much higher than normal mortgage payment because I have a bad credit rating because of them. I had overpaid by £5k which they eventually admitted but I never got anything back as they had already paid it to him and said they could not get it back but would reduce it from future payments. Then I became the PWC and I just left it alone because dealing with them had made me ill and I was just happy that they were leaving me alone. In 4 years whilst I was PWC they never got a penny from him despite telling me they had passed it to the enforcement team (he has his own business so declares really low income and even attempts to show his lifestyle did not match were rejected), now I'm back to being the NRP & he says he's making a claim against me. Surely this is unfair. I'm so scared that they'll do a DEO and I'm frightened that I will end up losing my house this time. I know that I would certainly not get another mortgage if I did.
Please advise if you have any idea what I can do.

Was this a CSA1 or CSA2 case, did they take the 40% because of arrears. If the arrears are not clear and there is a new case then it would be the 15% for one child.
I would hope that the £5k overpayment which they said would come off future payments would count as a credit for x months, do you have that in writing from them?
but then again it is the CSA we are talking about..0 -
it is CSA2 they took 40% because he said he had not received money from me which he had and even though I provided bank statements (thankfully I had done it via a standing order) they kept telling me that was not enough evidence and it took a couple of years before he agreed he had, had it. I wouldn't mind but I was paying up the money at the CSA rate without them being involved and he involved them.
No I don't have anything in writing from them about the overpayment sadly.
I can't believe he could contact them after 4 years of him not paying and them not making him pay up for those years but letting him make a claim against me.
Also he's discouraging my child from coming to stay so he'll get more cash which is really sad as I miss them so much.0 -
Well I'd ask them for the overpayment back from previous times ASAP for starters. Yes it can be done, but you may need to be persistent.0
