Have they put on a default or not???

Right, I am paying an old contract off with Orange, to be fair to them they have sent me letters for months and I have buried my head in the sand. Anyway 3 weeks ago I phone them and they tell me the debt is now with Global Debt Recovery Service, so I phone and arrange payment plan with them to clear the debt. This is all well until I receive a letter today saying we have been instucted bla bla bla..............................................."a default has been registered on your credit file with a cdreit reference agency".
So I phoned up going mad as I havent had any new defaults for over a year and didn't want a new one added and he said "we haven't put one on your file" so I asked if he could gaurentee me and he said "no as I don't have access to your credit file I can't check"
Now I am worried as although he says no, the letter definately says yes and once they are on they don't come off(as I am led to believe).
Anyone have any advice on what I should do next? Or shall I just believe him and hope for the best??

  • As far as I know only ONE default can be added per account, it can only be added by the original debtor and legally has to be issued before the debt it sold.

So the one form Orange is the only one you will get for this account.

  • Hi there i currently have a disconnection notice from Orange on my credit report from 2001 not a default. I don't know if this is what they do instead of a default notice (still as damaging I think). To view your report free for 30 day log onto credit expert from experian more details on this from MSE main site. You will then be able to view any notices on your report.

Hope this may be of some use, I have a default from a bank which is due to be removed in 1 month, I have been repaying the debt to a collection agency and it is no where near repaid. I contacted Experian so they could put a note on my account they said it would n't make any difference to lenders and it will be removed soon. The way i see it is I might as well not made any attempt to repay it especially to a collection agency as the damage is done now. A default is removed after 6 years and as i see it by agreeing to repay a debt collection agency you could then have a default notice put on there from them should you break the repayment agreement.

As in my case, agreement made with agency to repay 1 year ago, I still have 2 years worth of repayments to make. Default to be removed soon but I will still need to keep paying it back or risk another default notice from collection agency tarnishing my credit report for ANOTHER 6 years!

Let me know how you get on or if i can be of anymore help
  • Well Orange haven't issued me with a default as I know of and I wont have a disconection notice as the contract had ended. Maybe I should get my credit file in a few weeks and see what they have done
  • Get your credit file asap! I promise you it will save you a lot of lost sleep and worry. Be sure to enter your past addresses over the past 6 years though.
