Shop Direct Finance - Default

I'm absolutely fuming this evening!!! I recently cleared the balance in full on my Shop Direct account - and then requested to close the account - which I received a letter from them to confirm.

Having just checked my credit report this evening. They have marked the account as 'satisfied' and added a 'back dated' default marker to the 12th June 2009

I have never received a default notice and I rang made the final payment and closed the account - how can they do this!!! :mad:

    You need to complain about this, not acceptable to put on a default 12months late.

    First probably write for a copy of the default notice, they need to be able to prove one was sent.

    Thanks Tixy - yes I was in an Arrangement to Pay - which is how it's been stated on my credit report for months.

    I've also just seen that they have marked it as 'satisfied' not settled when I paid the full balance!

    I have a letter here dated 31st May stating that the account is closed - but they update my file on 04th July 2010 - the account's closed!! :mad:

    I'm so mad - I'm just in the process of trying to clear up my credit file and I can't believe that they have done this to me.

    Do you suggest I write a letter to them first and then make a formal complaint to FOS & ICO ??

    Sorry I'm a bit erratic tonight but I can't believe that they've just done that..:(

    Yes I think you need to write to them first to ask them to correct it. You can't make a formal complaint until you have used their own complaints procedure first.

    Have you got a hard copy of your file from before the default went on? if so might be useful at some point so hang on to it.

    Yes - I have retained everything...

    I have just typed a complaint letter stating what has happened and requesting they provide me with a copy of the default notice in line with their legal obligations s.87 & s.88 etc...

    I have stated that if they can't supply it they need to remove all adverse information - as per Niddy's templates.

    I'm just so annoid - it's like taking 1 step forward and 25 back.

    Had I not have 'formally' closed the account I don't think they would have done anything - how annoying is that!!

    How bizarre - it's experien that is showing all the data I have posted above:

    However having checked both Equifax and Call Credit, it's not showing as a default.

    Equifax:
    States I closed the account: 26th June 2010 - not true!
    Worst Status: Arrangement to Pay

    Call Credit:
    States the account is: delinquent but showing as Settled...

    Bizarre...

    Have you send a SAR to get a copy of all the data they hold on you? If they don't supply a copy of any default notice that they sent to you, this should bolster any complaint you make to the ICO.

    Edit: Just seen on your other thread that they had issued default notices. You should do a search for posts by 10past6 on defaults. I don't think this has been issued correctly.

    They say payment by 27th
    That's 14 days, but you will not have received the letter until after the 13th so you have not had 14 days. Is it 14 days they are required to give you?

    I'm sure 10past6 had said something along those lines in one of his posts. Can't look for it tonight but hopefully you'll be able to see others he has commented on.

    Thanks George - sorry this is something different - I should have kept it all one thread though.

    My other thread talks about Sainsbury's/HSBC etc... - this is Shop Direct who never issued a default notice and have applied everything to my credit file after I closed the account.
