Bailiffs came today please help

    I'd be interested to hear how a Bailiff could get a warrant for arrest!! lol

    Just don't answer the door, if they get physical with you or your property, call the Police.

    he's talking absolute bs. He can't get a warrant for your arrest because you don't owe anything, and there's a limit on what fees he can charge, which is nowhere near the thousands (it's around £42 if you don't let him in).
    Unless I say otherwise 'you' means the general you not you specifically.

    If they enter your property and start taking good, get them with a super soaker (water pistol) sure they will run out the door then. It's your house.

    He wasnt aggressive but he did say things ie Ill be back with a warrant for your arrest, and my fees will run tino thusands which will mean you ust pay more.

    He's allowed to charge £42.50 for two visits.

    Best not to involve the police as they don't understand bailiff law. My guess is the bailiff would be more scared by the Christians against Poverty rep!

    Contact the court he is working for, should be on the letters you got from the court. Notify them that a bailiff they have instructed has threaten to charge thousands in fees and get a warrant for arrest, you consider this harassment and a breach of the peace for the comments made, as the bailiff cannot obtain an arrest warrant for a CCJ.

    If they are a certified bailiff, it may well do you good to report their actions and see what view they have to take on it.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    DC - it's council tax, I think. Not a ccj. It'll be private bailiffs (some rogues like Rossendales), instructed by the council. So the complaint goes to the council.

    Court bailiffs normally behave themselves.

    You are correct, I've re-read the OP. Private bailiffs can be a pain indeed. £42.50 for 1 visit and 2 letters. If they can't gain peaceful entry they are stuck with that unless they levy on a vehicle. A complaint to a local counsellor/MP/Council is the way to go. Get the council to take the debt back and handle it themselves.

    The fees go up for a legal levy only - so if they levy on your car, since it's not your debt it doesn't count. Just to make that clear so you don't worry!

    The bailiff cant get the warrant but if its returned to the council then they may apply for commital action at which the magistrate can issue an arrest warrant.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
