Hi there
Wondering if anyone can help?
I started a weekend job a couple of weeks ago (working 10 hours over a weekend). I just received my contract and it says nothing about sickness benefit only mentions Position, Hours, Salary, and Holidays and a 6 month probationary period.
Are there standard 'things' that should be in a contract of employment? I don't want to be a fool. How soon can I take holidays and how do I work out how much holiday I have to take?

Hiya Annie,
Your employer should issue you with a statement of terms of particulars of employment within 2 months (this may take the form of the contract of employment) - there are standard things that this must include, one of them being "incapacity for work due to sickness or injury, including any provision for sick pay".
Not sure about holiday entitlement - there is a formula i think - so once youve worked a certain amount of hours you are able to take holiday.

According to ACAS (always a good source of information about employment issues) a statement of terms and conditins of employment (contract) should contain the following:
The following details must be included in the written statement:
the employer's name
the employee's name
the job title or a brief job description
the date employment began(9) the place of work and the address of the employer
the amount of pay and the interval between payments
hours of work
holiday pay entitlement
sick pay arrangements
pension arrangements
notice periods
where the employment is not permanent, the period it is expected to continue
where the employment is for a fixed term, the date when it is to end
grievance and appeal arrangements
disciplinary rules and any disciplinary or dismissal procedures (as a minimum these should comply with the statutory procedures)
any collective agreements which directly affect the terms and conditions
where the person is required to work outside the UK for more than one month: the period he/she is to do so; the currency in which salary will be paid; any additional remuneration payable by reason of working outside the UK; and any terms and conditions relating to his/her return to the UK.

holiday pay is normally worked out for every 13weeks of work you are entitled to a weeks holiday. there fore 4 weeks holiday a year. so your holiday will be in fact four weekends a year (not whole weeks). if u leave employment and have taken holidays not owed to you they can deduct this from your payslip0

What if you don't receive a written statement of employment particulars within two months? There are three of us at work, for two of us the two months is up tomorrow, for the other one, it has been 5 1/2 months and no contract or written statement of employment particulars.Quidco cashback paid out so far £745.89 :j0

If you're not sure, I would ask at your place of work. There may be more information coming your way anyway, but if you'd like to know it's worth asking anyway.Indecision is the key to flexibility

You can complain to an employment tribunal. But I would suggest (as I always do) that they talk to their Line Manager0 -
Even though your employer is in breach of the 1996 Employment Rights Act by not giving you written terms and conditions it makes no real difference to you and in fact you can use it to your advantage. For instance you could give a week's notice if that suited you.
All terms and conditions as laid down by ACAS are implied in the absence of the contract.I personally wouldn't worry too much-just shout when there is an issue you don't like and doesn't suit you. If things went to a Tribunal the Tribunal would I suggest side with you in the absence of a contract.
ACAS always very helpful. Give them a ring if you like.Best though speak to line manager as someone else said first, if you are that concerned.0
