Harassment By Debt Management Limited UK

Hi

I posted a thread the other day, in relation to a debt I could not pay years back (over 6 years ago)
With reference to my post and the letter I had from Debt Management Limited, they did send a Debt officer to my address.

The reason for my posting now, is I believe they have broke the law and committed a Criminal Offence, namely Harassment (Not put in fear of violence)

The agent from Debt Management Limited called upon my address at 10:10pm - which I believe they are not allowed to do, as this is an 'anti-social time' to call.

Can someone please advise if they too believe that, Debt Management Limited (UK) have committed an offence under the Protection from Harassment Act

    Thanks Niddy ;)

post number 5, part 6 is for you

It does seem as though you are being unfairly harrassed, although I haven't seen your other posts, if the debt is in dispute and/or statute barred, they shouldn't be sending people to your home, certainly not after 10pm.
See the "Debt collection guidance" Section 2.6 (a)
"Examples of unfair practices are as follows: Contacting debtors at unreasonable times and at unreasonable intervals"
So, yes, I think they probably have committed an offence.

(Have just read your other post, did you send the SB letter?)
"I may be many things but not being indiscreet isn't one of them"
  • Hi

In my opinion 10:10pm is far to late to be sending a debt collector around and I am sure you could now use this to your advantage.

    These people are scum !

Don't let them intimidate you, hopefully more knowledgable people will be along soon to offer you some brilliant advice, I just wanted to give you a bit of support.

    Thank you :)

Oh, don't worry these people don't scare me in anyway.
I didn't answer my door and had he have knocked for any amount of time I would have involved Police.

The fact is, any debt collection agency knows my problems and knows I can't afford to repay the debt, if there stupid enough even after evidence and a barred debt to keep trying to get it and then put fees on top that's there fault.

Should i get any more letters from them I will be writing to them once advising that if there conduct continues, in relation to there threats, after hour doorstep calls I will be reporting the matter to Police for them to consider the matter.

The debt isn't in dispute, the debt was for bank charges.
If the banks spent more money saving there customers than going after barred debts maybe they wouldn't be going bust........!
