hi all,
from the begining!
about 9 / 10 months ago i ended up missing a weeks wages due to a mix up, work accected this a few weeks later once pointed out an explained. i was told you'll get it this week or next, several times! then he said he coundn't afford it at the mo and i'd get it once he could.
a couple of months later that company went bust, but started up with the same people under a different name. in the inbetween stage we didn't get any wages for about 5 weeks. once wages where 'sorted' again i was owed weeks 27(mix up from the previous co), 1, 2, 3 (from the new co). around april i asked the boss when he thought he'd get caught up with all the owed money, he said realistically may / june. yesterday i asked him hows it looking on the money front, he said if it carries on like this we'll be shutting, if it doesn't pick up soon there could be lay offs on this friday.
i had a friend lose his job with them last year, he was also owed week 27, the administrator got him payed out from the gov, but this is capped at £380 topline = about £270 take home which left my mate about £95 out of pocket. the administrator said that the new company was responsible for my week 27 as the new company had taken me on. if the second company goes bust will i be able to claim monies owed from 2 companies that have gone bust?
the four weeks i'm owed comes too just short of 2k (take home) + week in hand wages, if the second company goes bust, at best i'd get £1080 take home or £1350 inc week in hand, is there a cap on how many weeks owed the gov cover?
what are my options? i'm not rich (working 60 / 70 hours pw) and don't want to be loosing a grand if it can be helped.
cheers steve
