Can you get a Default with no credit agreement signed?

Hello

Is it possible for a company to lodge a Default against your name if NO credit agreement was ever signed.

I don't think so but can anyone confirm this.

    you can get a default, if you have a telephone service e,g bt and you dont pay the bill

    even gas and electric

    but mainly if you sign for a credit aggrement, and pay late eventually this will result in a default,

    have you had a default of a company that you have not sighned an agreement with?
  • Technically a default does not have to relate to a Consumer Credit Act governed agreement, you can in some cases (i.e Mobile Phones / Catalogues) receive a default notice that is issued in relation to a breach of contract law, a default after all is just a notification that a contract has not been honored in line with the original T&C’s.

    However the lack of a properly executed CCA agreement will make it unlawful for the creditor to pursue the outstanding debt under the CCA, but the default information is governed under the data protection act, and not the CCA.
