Equita Bailiffs

I had a payment plan in place with Equita for unpaid council tax, I was subsequently laid off and couldn't afford to keep up with the payments. I had informed them that I would only be receiving Job Seekers Allowance and that due to this was unable to keep up with the plan. Now they are threatening me with bailiffs and allsorts.
Being unemployed and on benefits where do I stand with this?

I am currently having some issues with Equita as well regarding the fees they are charging on top of my debt. I had to do a lot of reading and scanning thru this site to get advice and know what action to take. I would say to speak to your local authority first, tell them about your change in circumstances and see if they can arrange an alternative plan. Copy the letter into Equita as well.
In the meantime seek as much advice as possible from National Debtline and some of the sites that posters have put on here. As i am a new user I am not allowed to post links but if you google Bailiff advice or do a search on bailiffs on Money saving expert then some of the posts which give some good advice should come up.
Sorry that's all I can say at the moment but i am sure someone will post with more informed advice.
Best of luck tho and I hope that somehow things work out.0 -
There are people much more experienced than I am, but heres a few tips that have helped me in the past with these bullies!
If you own a car, park it away from their property.
If they come to the door, refuse to let them in. Without a walking posession agreement, they cannot 'force entry'.
At this point, the maximum charges they can apply are £24 for the first visit, and £18.50 for the second. No other fees like 'Enforcement' can be charged, they are illegal, and they know it; its a bullying tactic to line their pockets!
Now, as said before, write to them and ensure everything is in writing only. Make sure you mention that you do NOT give permission for anyone from Equita, or working on behalf of Equita to attend your property.
Reference your circumstances, and make sure you mention that you are NOT refusing to pay, more that you need to re-negotiate payments whilst you seek employment.
If they come back and refuse, respond saying that you believe that they are being unfair, and make sure you mention that you're sending the letter to your Chief Exec of your local council (I did this and oh boy did it work).
I hope this helps. Its not professional advice; just my experience.Geek by Nature.. Geek by Profession!
