Hi Gary
I hope someone will be along soon to give you some help - I don't know enough - but you've come to the right place.
It sounds a dreadful situation to be in, especially with young children. Hope you can sort something out. (((hugs)))0 -
So, on your N244 you are proposing suspending the eviction by paying the contractual instalment (£387) plus £113 per month towards arrears of £2200. Is that right?
Your plan clears the arrears in 20 months.
On the face of it, it seems reasonable.
But what was the plan that you defaulted on? Was that a suspended possession order, rather than a suspended warrant of eviction? How are you going to make the judge believe that things are different now? Is it that the non-priority debts are gone now and you can concentrate on your mortgage?
Pleased to hear that Shelter are helping you. They are excellent at this sort of thing.
I think you've got a good chance as long as you can show that you can afford the £500. Let us know how you get on.0 -
Hello Gary
I agree with FB above. On the face of it you have a good prospect of the warrant being suspended on payment of the contractual instalment plus £113.00 month off the arrears, which appear to be relatively modest. I am assuming that this is your first application to the court to suspend a warrant. No doubt the District Judge will also take into account the fact that the mortgage instalment will reduce at the end of your fixed term.
You may have to demonstrate to the District Judge that you have sufficient income to meet your proposal
I am sure all will be fine
Good Luck
