Capitalone won't let me cancel

HI,
I HAVE HAD A CAPITAL ONE CARD FOR A FEW YEARS NOW THE ONE THAT YOU HAVE TO PAY A YEARLY FEE. THE BALANCE WAS ZERO AND THEY STATED THE NEXT STATEMENT WILL INCLUDE THE YEARLY FEE. I DECIDED I DID NOT WANT THE CARD NO MORE SO I WROTE A LETTER CONFIMING THIS AND HAD NO REPLY. NEXT STATEMENT CAME WITH THE YEARLY FEE ON IT TO BE PAID,I RANG THEM UP TO COMPLAIN AND THEY SAID I HAVE TO KEEP THE CARD BECAUSE I SIGNED A CONTRACT. NEXT STATEMENT CAME WITH CHARGES ON NOW. I CANNOT REMEMBER SIGNING ANYTHING THAT SAY'S I HAVE TO HAVE THIS CREDIT CARD FOR LIFE!!!!:mad:
1. IS THERE A TIME LIMIT YOU MUST KEEP THE CARD?
2. SHOULD I TAKE MY COMPLAINT FURTHER?

I THINK I HAVE HAD THIS CARD FOR AT LEAST 3 YEARS NOW.
CAN ANYONE ADVISE PLEASE?

    What do your T+Cs say about termination and annual fees? Whether or not your signed anything, this is what you would be bound by (within/as modified by statutory rights).

    Any chance of not writing everything in CAPS?

    You are going back a while, the classic one used todo this and even if you cancel you have 14 days to before you are liable for the annual charge. Although they no longer charge it.
  • Yes i had this card and a while back (a year or more) I was told the annual fee was beiing cancelled (probably in lieu of a higher APR).

    Check your terms and tell us what they say.

    I think I will pay up the yearly fee and the £12 charge they gave me and send the card back with a covering cancellation letter by recorded delivery and see what happens. All I can find on my credit card agreement about my rights is-(You can settle this agreement at any time by giving notice in writing and paying off the amount you owe under this agreement).
    I had already sent a letter but unfortunatly NOT by recorded delivery and phoned them up but that did not go well.
