Capquest Statutory demand help needed urgently

Im hoping someone could help or provide advice

I had a hp agrrement on a car stereo back in 2001 the items were faulty and returned the goods to the store who said tehy would cancel the agreement

Capquest now have the debt and have bumped it up to £1982 yet at christmas offered a settlement of £646!!! they now have sent a letter saying they will issue a "Statutory demand" and could make me bankrupt


1st. how will this affect my other loans that i am regular paying
2. I have asked them twice for a true copy of my agreement and nothing! yet they keep adding interest on!
3. They sent me a discounted letter back at christmas to pay £646 and now they have bumped it up to £1982
4. They harresed my parents house 5 times a day upto 10pm at night!!! calling yet they had my number

What is the best avenue for me to take? can they really make me bankrupt

I do not own my house and have nothing worth anything apart from my phone


Also as they have not contacted me directly would this be classed as Statutory barred? (been doing my research) i honestly dont mind be taken to court as i do not own anything of vaulable worth the ex already had all that

Any help would be great thank you

    If it was a debt from 2001 and you have not paid or admitted it since then yes it is statute barred, they are trying to frighten and worry you and will not make you bankrupt over a debt that old!
    Credit card debt - NIL
    Home improvement secured loans 30,130/41,000 and 23,156/28,000 End 2027 and 2029
    Mortgage 64,513/100,000 End Nov 2035
    2022 all rolling into new mortgage + extra to finish house. 125,000 End 2036
  • another thing i checked also was my credit report and there is nothing on my credit report relating to the debt or the original loan provider clydesdale? if its not on my credit report is that good for me etc?

    Unless they know you have money they won't do a statutory demand, because it costs them about ~£1500 to do so and they will not be aware if they can really get their money back.

    I agree, if you have not paid or given written acknowledgement that you owe this money for a period of 6 years at any point, then the debt is statute barred anyway added to the fact you are disputing it. As the goods were faulty and returned.
