Getting paid late !

Hello, over the last 6-9 months my husband has been continually paid late. His contract states that he should get paid on the last working day of each month. To start with it was a case of if the last working day was a Friday he would get paid on the Monday instead, but it just keep getting pushed further and further back. He should have been paid today (well he SHOULD have been paid on Wednesday - 30 June -) but has now been told it will be Monday - 5 days late! :mad: All our direct debits go out between the 2nd and the 5th of the month so when this happens we get clobbered with bank charges. There is always some excuse why he doesn't get paid on time - the annoying thing is I don't think the company even has financial issues - it's just that the boss (more specifically his wife) is far more interested in his own cashflow than that of his employees :mad:

Does anyone have any advice (besides getting a new job as he is in construction andn not much about) on how to handle this - any resident employment lawyers out there?!:D

    It could be worth, in the first instance, your husband having a VERY calm and collected discussion with the boss or his wife about the impact of you not getting paid on time and the resulting bank charges. Of course, this could end with her saying "I really couldn't care less about you, I'll do what suits the business" - which, if it happened to me, would leave a very sour taste in my mouth and hasten my departure (as you state, not as easily doable right now!)

    Another thing to consider is your bank and procedures there. Do you have an overdraft? Going over any pre-agreed limit will be much more expensive than going in to an agreed overdraft. Also, what are the T&Cs on your bank account? For example, on my Alliance and Leicester account it costs me 50p per day I am in the red, regardless of by how much, up to £5 per month, whereas my HSBC account charges a high APR on the overdraft usage, but this still tends to work out a fraction of any A&L charges on the odd occasion that I go over.

    You could also look at changing the payment date of your direct debits - a quick phone call to the relevant companies and they should agree to change the payment date, e.g. to the 10th of the month- no need to explain why you want to do this, just say you want to change the payment date. Some may refuse as they have set collection dates, but surely if some of the DDs went out early and others later that might at least reduce the impact of the bank charges?

    Good luck with getting this resolved one way or the other. Obviously the best case scenario is that your hubby gets paid on time, but please do consider the damage limitation by looking at your banking set up.
