CSA arrears help please!

Hi,i have written on hear a number of times over the last few years and received some great help but i need more!!
Basically years ago i received a bill for £52000 which i challenged via a solicitor and with help i got it down to about £9000 which i still dispute but had no fight left in me so started paying at £50 per month.Incidentally the children in question are now in there twenties!Anyway i now owe about £7800 and had a letter yesterday to say they want it back in 2 years as its owed to the secretary of state.I take home £1300 per month and my protected earnings is £900 so they want £322 per month for the next 2 years which will break me as i have outgoings of nearly £1000.I`ve offered to double my payment to £100 per month but its fallen on deaf ears. They are now talking of doing a deduction from earnings and i really dont know what to do! There is no liability order in place by the way and the arrears date from 1992 to 2002.I was rather naive and paid the mother direct so as she was on benefits she denied receiving anything.....please help guys!!! Thankyou.

I would go to my MP with a full breakdown of your costs and ask them to negotiate on your behalf - housing costs would be a priority, but if you have credit card bills they won't be classed as important as child support.

My housing costs are within my protected income but i also pay £200 permonth child support for other chuildren which they wont take into consideration due to it not going through the csa!Can they just go ahead and do the DEO despite my appeals and even though i`ve offered to up my payment?

Yes, I'm afraid they can - why not get the other two onto the CSA then your payments will be much less.
  • Am i right in thinkin only a PWC can open a case???

My brother pays £120 per week on CSA1 (includes arrears) to PWC1 who left him when DS was a toddler, refused acess, etc

When he split with PWC2 she refused to go through CSA (hated them), but brother couldn't afford private case on top of £130 per week for CSA case.
Part of divorce settlement was go through CSA or receive nothing. She chose nothing.

Brother tried to get both cases on CSA2 so both children receive something, but was told NRPs cannot open cases.

    Is that right???

The PWC would have to agree to receive money through the CSA, other wise there would be no details of where to send money etc and a case couldn't be opened ... but then, if left with the decision of CSA or nothing, most would probably cooperate with the CSA.

If I were your brother, id set up a savings account for the other child, so they got something when they're older perhaps.

  • Thats the whole point though.
He cant afford to put anything else in a savings account on top of £120 per week, plus mortgage, bills, etc....
He buys him clothes, etc when he stays with us, pays for his mobile, but cannot afford anything weekly..
But his mum was given the choice and said she'd rather have nothing, than have any dealings with CSA.
1st PWC won't take private arrangement so it's catch 22......

he can apply to the CSA for the other case to be put with them, and refuse to pay the other mother any more direct - she will either have to accept CSA payments or have nothing.
