employment law question please

Hi

Please could you advise me on the following.

My husband is off work due to work related stress. He has been working 90 hr weeks etc and all of it has caught up with him. He is in talks with hr to rectify the situation which is great but soon he wont be on full pay as its only for the first 8 weeks. What i was wondering is that are they liable to continue paying him full pay as he is off due to a problem at work not say a broken leg??? I hope ive made sense?

    I'm afraid not. Sick is sick. The problem is the problem. In other words, his contract stipulates what his sick pay provision is when off sick (for any reason), and that is the provision he is entitled to. An employer may decide to extend this even if the contract doesn't say so - but no sensible employer is likely to do so, as it would be tantamount to an admission of liability. It also creates precedent, which may then become costly to the employer. So you could ask - but I wouldn't wager the family jewels on a psoitive response. Sorry.
